Pursuant to authority conferred by law, including
the Condominium Act (Public Act 59 of 1978, as amended), all condominium
projects within the Township of Grosse Ile shall be approved by the
Township Planning Commission and the Township Board. In determining
whether to approve a condominium project, the Planning Commission
shall consult with the Zoning Officer, Township Attorney, Township
Engineer and Township Planner regarding the adequacy of the master
deed, deed restrictions, utility systems and streets and layout and
designs in compliance with all requirements of the Condominium Act,
applicable state laws and the ordinances of the Township of Grosse
Ile.
For purposes of this chapter, the following
terms shall have the following meanings:
CODE or CODES
The Code or Codes of Ordinances of the Township of Grosse
Ile.
CONDOMINIUM PROJECT or PROJECT
A plan or project consisting of not less than two condominium
units established in conformance with the Condominium Act.
CONDOMINIUM UNIT
That portion of the condominium project designed and intended
for separate ownership and use, as described in the master deed.
DEVELOPER
A person engaged in the business of developing a condominium
project as provided in the Condominium Act.
EXPANDABLE CONDOMINIUM
A condominium project to which additional land may be added
pursuant to express provision in the condominium documents in accordance
with this chapter and the Condominium Act.
MASTER DEED
The approved and recorded condominium document recording
the condominium project, to which is attached as exhibits and incorporated
by reference the approved bylaws for the project and the approved
condominium subdivision plan for the project.
TOWNSHIP
The Township of Grosse Ile, Wayne County, Michigan.
ZONING OFFICER
The Zoning Official designated in Chapter
285, Zoning, Article
24, of the Grosse Ile Township Code.
Concurrently with the necessary notice required
to be given to the Township of Grosse Ile pursuant to the Condominium
Act, a person, firm or corporation intending to develop a condominium
project shall provide the following information with respect to the
project:
A. The name, address and telephone number of:
(1) All persons, firms or corporations with an ownership
interest in the land on which the condominium project will be located
together with a description of the nature of each entity's interest
(for example, fee owner, optionee, or land contract vendee).
(2) All engineers, attorneys, architects or registered
land surveyors associated with the project.
(3) The developer or proprietor of the condominium project.
B. The legal description of the land on which the condominium
project will be developed together with appropriate tax identification
numbers and proof of ownership of the land acceptable to the Township.
C. The acreage content of the land on which the condominium
project will be developed.
D. The purpose of the project (for example: residential,
commercial, industrial, etc.).
E. Approximate number of condominium units to be developed
on the subject parcel.
F. Whether or not a community water system is contemplated.
G. Whether or not a community sewer system is contemplated.
H. In addition to the foregoing, said person, firm or corporation shall also supply any additional data and/or information required by Chapter
238, Subdivision Control, of the Code of Ordinances of the Township of Grosse Ile and Article
8 of Chapter
285, Zoning, of the Township of Grosse Ile.
Notwithstanding anything in this chapter to
the contrary, no condominium project shall be approved by the Planning
Commission until the following requirements have been satisfied:
A. The Planning Commission determines that the proposed condominium project complies with the Condominium Act, the applicable provisions of Chapter
285, Zoning, and the site plan review and approval process set forth in Chapter
238, Subdivision Control, of the Code of Ordinances of the Township of Grosse Ile.
B. The proposed condominium project, if abutting a portion
of a public road, must have said public road improved to the boundary
of the project site.
C. All site condominiums shall comply with the design standards of §
238-7 and required improvements of §
238-8 of Chapter
238, Subdivision Control. All site condominiums shall be reviewed following the procedures of §§
238-4 through
238-6 of Chapter
238, Subdivision Control.
D. All condominium units shall be served by the Township
public water and sanitary sewer system.
Prior to expansion or conversion of a condominium
project to additional land, the new phase of the project shall undergo
site plan review and approval pursuant to the provisions of the Condominium
Act and this chapter.
The condominium project developer shall furnish
the Township with the following: one copy of the approved and recorded
master deed, and one copy of all restrictive covenants. The Master
Deed shall be approved and recorded before any condominium units shall
be sold, conveyed or leased in the condominium project.
All condominium projects shall be marked with
monuments as provided in the Condominium Act and the applicable ordinances
of the Township.
The Township Board shall not give its final
approval to any condominium project until all of the provisions of
the Condominium Act and the provisions of this chapter are satisfied
and until it has received the recommendations of the Planning Commission
after the public hearing concerning same.
Notwithstanding anything in this chapter to
the contrary, all condominium projects shall comply with all federal
and state statutes and all local ordinances.
All developers of condominium projects within
the Township shall pay the required site plan review fees in accordance
with the schedule of fees posted in the Township Clerk's office.

Penalties for violation of this chapter shall be punishable as provided in Chapter
1, General Provisions, §
1-3. The provisions of Chapter
1, Article
II, Municipal Civil Infractions, also apply to violations of this chapter.
