An award of damages fixed as the annual allowance may be paid to policemen or firemen who are permanently disabled through injuries received in the performance of their duties during the term of such disability as hereinafter provided.
Before any award is made as an annual allowance during such disability, a certificate of the City Physician, or such other physician appointed by the Council, certifying as to the probable permanency of such disability shall be filed with the City Manager. Upon the filing of such certificate, the City Manager shall recommend such policemen or firemen who are permanently disabled through injuries received in the performance of their duties for an award under this article.
Upon filing of such recommendation by the City Manager, an annual allowance may, by ordinance, be awarded to such policemen or firemen who are permanently disabled in the performance of their duties. Said annual allowance shall be the difference between the amounts such person was paid when employed in the municipal service and any pension paid and any award made under Workers' Compensation, Title 11A of the Revised Statutes of New Jersey. After the day of final payment under any workers' compensation paid under Title 11A of the Revised Statutes of New Jersey, the annual allowance shall be the difference between the amount paid such person when employed in the municipal service and the amount of any pension paid to such policeman or fireman. The annual allowance shall be paid during such disability in semimonthly installments in the same manner as all salaries of the City are paid.
In order to determine the continuance of such disability, each policeman or fireman awarded an annual allowance under this article shall present himself to the City Physician, or such other physician appointed by the Council, for an annual physical examination. The City Physician, or such other physician appointed by the Council, shall file with the City Manager annually a certification as to the probable permanency of such disability of each policeman or fireman receiving such an award.
If, after any examination made pursuant to § 73-13, the City Physician, or other physician appointed by the Council under this article, shall find that such disability no longer continues to exist, he shall file a certificate with the City Manager certifying that such disability no longer continues to exist. Thereafter, all payments under this article to such policeman or fireman shall cease as of the date of the filing of said certificate.
