A. 
In order to divide, partition or assemble any land in the Township, such land, parcel or lot shall have proper frontage on one of the following:

(1) 
An improved public road;
(2) 
A private road approved by the Township and constructed to Wayne County standards for paved streets, that meets the requirements of this chapter; or
(3) 
A nonconforming gravel road, as defined in Article I above.
B. 
In determination of compliance with lot area standards, land located within a public street right-of-way or a private road easement shall not be counted. Dividing, partitioning or assembling land must be in compliance with the lot split regulations contained in Chapter 285, Zoning.
A building permit shall not be issued by the Township or any department or official of the Township, unless the following requirements are met:
A. 
The structure, building or improvement for which such building permit is required shall be on a lot or parcel of land which meets the requirements of this chapter and the entire lot provides frontage required by Chapter 285, Zoning, along one of the following:
(1) 
An improved public road that meets the requirements of Subsection B below;
(2) 
An approved private road constructed to Wayne County standards for paved streets, that meets the requirements of this chapter is approved by the Township and meets the requirements of Subsection B below; or
(3) 
A nonconforming gravel road, as defined in Article I above.
B. 
An improved public street or approved private roadway must be constructed to current Wayne County standards for paved streets and meet the road standards contained in this chapter. Concrete curb and gutter shall be provided for the entire length of the lot's frontage. If the roadway upon which said lot fronts does not meet the requirements contained herein, it shall be the responsibility of the applicant to improve the road for the entire length of the lot's frontage to Wayne County standards for paved streets, and also meet the road standards contained in this chapter. If all adjacent segments of the road lack curb and gutter, then the Township Department of Community Development can allow a gravel shoulder with open ditches.
C. 
A copy of an approved Wayne County Department of Public Services driveway permit for access to a public road, or evidence that the parcel has recorded right to access an easement for a private road shall be submitted prior to issuance of a land use permit. The Township Building Inspector shall not issue a certificate of occupancy unless the driveway and any required drainage culvert are installed to the standards required by the driveway permit and this chapter.
D. 
Driveways that access a hard surface roadway shall be surfaced within the right-of-way with a type of material which is equal to or better than the surface of the roadway which it joins. The slope for any portion of the driveway within the road right-of-way shall meet Wayne County standards.
No land outside of a public street right-of-way within a residential district shall be used for vehicular access to any nonresidential land use located in a nonresidential district, except for an access to an essential service.
A. 
All driveways shall maintain compliance with the corner clearance requirements of Article 19 of Chapter 285, Zoning.
B. 
Roadside drainage shall not be altered, except as approved under a permit from the Wayne County Department of Public Services.
C. 
Continued maintenance of commercial driveways shall be the responsibility of the property owner(s) served by the driveway. Any repairs and maintenance to driveway approaches within the public road right-of-way shall be performed under an approved permit from the Wayne County Department of Public Services.
D. 
Any damage to roads as a result of constructing driveway or utility improvements within the road right-of-way shall be restored to original condition, meeting Wayne County standards, prior to issuance of a certificate of occupancy.
