It shall be unlawful for any person to willfully
enter any privately owned structure, facility, or building or to willfully
enter or go upon the premises thereof without lawful authority or
without having permission to do so from the owner, occupant, or person
in charge thereof.
It shall be unlawful for any person to willfully
enter or go upon the private land of another without lawful authority
or without having permission to do so from the owner, occupant, or
person in charge thereof; provided that, in the case of vacant land,
the owner, occupant, or person in charge thereof or their agent under
written authorization to do so has previously posted such vacant land
with a conspicuous notice prohibiting trespass thereon.
It shall be unlawful for any person who is upon
the private land of another or who is in any private structure, facility
or building owned by another or who is on the premises thereof to
refuse, neglect, or fail to depart therefrom without lawful authority
to do so upon being notified or told to depart therefrom by the owner,
occupant or person in charge thereof.
It shall be unlawful for any person to willfully
enter any public structure, facility or building or to willfully enter
any structure, facility or building open to the public at such times
when such structure, building or facility is not open to the public
without lawful authority or without having permission to do so from
the governmental authority or its representative having jurisdiction
thereof or, in the case of a structure, facility or building open
to the public, without having permission to do so from the owner,
occupant, or person in charge thereof.
It shall be unlawful for any person to willfully
enter or go upon public land or land open to the public without lawful
authority or without having permission to do so from the governmental
authority or its representative having jurisdiction thereof or, in
the case of land open to the public, without having permission to
do so from the owner, occupant or person in charge thereof provided
that such public land has been previously posted by the governmental
authority or its representative having jurisdiction thereof or, in
the case of land open to the public, by the owner, occupant, or person
in charge thereof or by their agent with written authorization to
do so with a conspicuous notice prohibiting any trespass thereon or
prohibiting trespass in certain areas thereof or prohibiting trespass
thereon or on a part thereof during certain hours of the day or night.
It shall be unlawful for any person who is in
any public structure, facility or building or who is in any such structure
open to the public or who is upon any public land or upon any land
open to the public to refuse, neglect, or fail to depart therefrom
without lawful authority to do so upon being told to depart therefrom
by the governmental authority or its representative having jurisdiction
thereof or, in the case of land open to the public, upon being notified
to depart therefrom by the owner, occupant or person in charge thereof.
It shall be unlawful for any person to willfully
enter any structure, facility, or building located on or at the Grosse
Ile Township Airport or to willfully go upon the premises thereof
without lawful authority or without having permission to do so from
the Grosse Ile Township Airport Commission or its representative or
without having permission to do so from the lawful occupant or person
in charge of such structure, facility or building.
It shall be unlawful for any person to willfully
go upon the land, landing field or runways or upon any other premises
of the Grosse Ile Township Airport without lawful authority or without
having permission to do so from the Grosse Ile Township Airport Commission
or its representative or without having permission to do so from any
occupant or person in charge thereof having the right or authority
to give such permission.
It shall be unlawful for any person to operate
any bicycle, motorbike, motorcycle, motor vehicle or any other vehicle
upon the land, landing fields or runways or upon any other portion
of the Grosse Ile Township Airport or to park any such vehicle thereon
without lawful authority to do so or without permission to do so by
the Grosse Ile Township Airport Commission or its representative or
without permission to do so from an occupant or person in charge thereof
having the lawful right to grant such permission; provided, however,
that the foregoing provisions shall not apply to public roads nor
to roadways or areas located in the Grosse Ile Township Airport designated
as roads or parking areas open to the general public during certain
hours of the day and night as designated by the Grosse Ile Township
Airport Commission.
The provisions set forth hereinbefore in this
chapter relating to persons entering upon airport properties and into
airport buildings shall not apply to authorized airport or Township
personnel, Airport Commissioners, and elected Township officials pursuant
to the discharge of their respective duties and responsibilities.
Such provision shall further not apply to Grosse Ile Township Airport
tenants and lessees and their respective employees, customers and
invitees and to such other persons entering upon airport properties
and into airport buildings for legitimate purposes or to members of
the general public who enter upon airport properties or into airport
structures, provided that, in all cases, such entry onto the lands
of the airport or into airport structures is in accordance with rules
and regulations adopted by the Township of Grosse Ile Airport Commission
governing such entry.
It shall be unlawful for any person who is in
any airport structure, facility or building or who is on any land,
landing field, runway or upon any other part of the Grosse Ile Township
Airport to refuse, neglect or fail to depart therefrom without lawful
authority to do so upon being notified to depart therefrom by the
Grosse Ile Township Airport Commission or its representative or upon
being notified to depart therefrom by the occupant or person lawfully
in charge or control thereof.

A person found guilty of violating this article
shall be guilty of a misdemeanor punishable by imprisonment in the
county jail not more than 30 days or by a fine of not more than $250,
or both.

As used in this article, the following terms
shall have the meanings indicated:
COMMERCIAL AVIATION OPERATOR (OPERATOR)
A person or persons, firm or corporation who, for compensation
or hire, engages in one or more of the following commercial activities
or operations utilizing airport facilities or property: air cargo,
aircraft charter, aircraft fueling, aircraft rental, aircraft sales,
airframe and/or power plant maintenance, avionics sales and maintenance,
aerial advertising, aerial firefighting, aerial powerline/pipeline
patrol, banner towing, flight training and sightseeing, or other aeronautical
activity. This definition excludes any person who is an employee of
an aircraft owner who is exercising his right to self-service his
aircraft with his own resources in accordance with Federal Aviation
Administration regulations. The burden of proof that the person is
an employee rests with the aircraft owner.
A. No person shall conduct any commercial aviation activity
or operations, or act as a commercial aviation operator, or conduct
other similar activities at the Grosse Ile Municipal Airport without
first securing a written agreement from the Airport Commission or
its designated representative and paying the required fees and charges,
as set forth in the Airport Rules and Regulations and Airport Commercial
Operating Standards.
B. Penalties for violation of this section shall be punishable as a municipal civil infraction violation as provided in Chapter
1, General Provisions, Article
II.
