As used in this chapter, the following terms shall have the
meanings indicated:
CARDBOARD
Corrugated boxes and similar corrugated and kraft paper materials
which have a minimum of contamination by food or other material.
COLLECTOR
Any party entity who holds himself out for hire to collect
solid wastes or recyclables from persons or entities within the Town
of Cromwell.
ENTITY
Any institution, public or private corporation, partnership,
association or any other party, public or private, however organized,
which generates solid waste at a location within the Town of Cromwell
other than a "person" as defined by this chapter.
GLASS FOOD CONTAINER
A glass bottle or jar of any size or shape used to package
food products suitable for human or animal consumption.
METAL FOOD CONTAINER
An aluminum, bimetal, steel, tin-plated steel or other metallic
can, plate or tray of any size or shape used to package food products
suitable for human or animal consumption.
NEWSPAPER
Used or discarded newsprint which has a minimum of contamination
by food or other material.
OFFICE PAPER
Used or discarded high-grade white paper and Manila paper,
including but not limited to paper utilized for file folders, tab
cards, writing, typing, printing, computer printing and photocopying,
which is suitable for recycling and which has a minimum of contamination.
Office paper generated by households is excluded.
PERSON
Any individual who generates solid waste from residential
property within the Town of Cromwell.
RECYCLABLES
Cardboard, glass food containers, plastic food containers,
metal food containers, newspapers, office paper, scrap metal, storage
batteries and waste oil.

RECYCLE
To separate or divert an item or items from the solid waste
stream for the purposes of processing it or causing it to be processed
into a material produce, including the production of compost, in order
to provide for disposition of the item or items in a manner, other
than incineration or landfilling, which will best protect the environment.
Nothing in this definition shall preclude the use of waste oil as
fuel in an oil burner.
SCRAP METAL
Used or discarded items which consist predominantly of ferrous
metals, aluminum, brass, copper, lead, chromium, tin, nickel or alloys
thereof, including but not limited to white goods and metal food containers.
STORAGE BATTERY
Lead acid batteries or other batteries used in motor vehicles
such as automobiles, airplanes, boats, recreational vehicles, tractors
and like applications.
TOWN
The Town of Cromwell, Connecticut.
WASTE OIL
Crankcase oil that has been utilized in internal combustion
engines, but excludes hydraulic fluids, cutting oils, mineral spirits,
paint thinners, gasoline and vegetable oil.
The following items shall be recycled pursuant
to this chapter:
J. Plastic food containers.

Each person and entity shall separate recyclables
from other solid wastes.

For residential units, glass, plastic and metal
food containers shall be rinsed and placed in recycling containers
provided by the Town or collectors; newspapers and flattened corrugated
cardboard shall be bundled and placed on top of the container. Recycling
containers shall not be used for other waste. Recyclables shall not
be mixed with other waste.
Containers of recyclables shall be placed curbside
before 6:00 a.m. on the day designated for collection.
Only the Town and collectors may collect recyclables
within the Town. From the time of placement at the curb for collection
by collectors, all recyclables shall become the property of the Town.
A collector who has reason to believe that a person or entity from whom he collects solid waste has violated the separation requirements set forth in §
147-3 of this chapter shall issue a warning notice and promptly notify the Town of the alleged violations. Collectors shall also assist the Town in identifying persons and entities responsible for mixing recyclables and solid waste in violation of this chapter.
The collection or pickup of recyclables not
authorized by this chapter is prohibited.
Collectors shall deliver recyclables to such
location or locations designated by the Town for processing and sale.
Notwithstanding other provisions of this chapter, the Town may from
time to time designate locations at which persons and/or entities
may deposit specified recyclables.
Notwithstanding other provisions of this chapter,
each person and entity shall separate waste oil from other solid wastes
and recyclables. Each person shall deliver waste oil to locations
designated by the Town. Each entity shall dispose of its waste oil
in an environmentally sound manner and shall report the method of
such disposal to the Town.
Notwithstanding other provisions of this chapter,
each person and commercial entity shall separate storage batteries
from other solid wastes and recyclables. Each person shall deliver
storage batteries to locations designated by the Town. Each entity
shall dispose of storage batteries in an environmentally sound manner
and shall report the method of such disposal to the Town.
The Director of Public Works shall promulgate
rules and regulations in conformity with this chapter. Such rules
and regulations shall be published at least once in a newspaper of
general circulation within the Town of Cromwell and shall be posted
in the Town Clerk's office.
Any person or entity violating any provision
of this chapter and/or any rules or regulations promulgated hereunder
shall be fined not more than $99 for each offense. Each continuing
day of violation shall be considered a separate offense. Notwithstanding
the foregoing, any collector shall be subject to the fines and penalties
set forth in Section 22a-220a of the Connecticut General Statutes,
as amended, for violations defined therein.
