[HISTORY: Adopted by the Board of Selectmen of the Town of Guilford 9-7-1994; amended in its entirety 7-7-2014. Subsequent amendments noted where applicable.]
The purpose of this chapter is to set forth the Town of Guilford appointed boards, commissions, councils, committees and authorities appointed by the Board of Selectmen or by Town Meeting, as applicable, which are in effect as of the effective date of this chapter, as amended. Temporary school building committees or other temporary committees or task forces are excluded.
The Agricultural Commission was established by authority of Chapter 3 of the Town Code and Public Act 11-188. The Commission shall consist of five members and three alternate members appointed by the Board of Selectmen for four-year terms in accordance with Chapter 3 of the Town Code. Terms shall be staggered.
The Building Code Board of Appeals was established by authority of C.G.S. § 29-266. The Board shall consist of five members appointed by the Board of Selectmen for four-year terms in accordance with Chapter 4 of the Town Charter. Terms shall be staggered. Members shall meet the qualifications set forth in the State Building Code. The Board shall have the authority set forth in C.G.S. § 29-266.
The Cable Television Advisory Council was established by authority of C.G.S. § 16-331 and Section 16-333-25 of the regulations of the Department of Public Utility Control. Three members are to be appointed by the First Selectman for towns having a population of at least 20,000. The members shall serve for two-year terms from the first day of July in the year in which the member is appointed. The Council shall have the authority set forth in C.G.S.§ 16-331 and the regulations of the Department of Public Utility Control.
The Conservation Commission was established by authority of C.G.S.§ 7-131a and Chapter 14 of the Town Code. The Commission shall consist of seven members and three alternate members appointed by the Board of Selectmen for four-year terms in accordance with Chapter 14 of the Town Code. Terms shall be staggered. The Commission shall have the authority set forth in Chapter 14 and Chapter 214 of the Town Code.
The Economic Development Commission was established by authority of C.G.S. § 7-136 and Chapter 20 of the Town Code. The Commission shall consist of seven members and four alternate members appointed by the Board of Selectmen for four-year terms in accordance with Chapter 20 of the Town Code. Terms shall be staggered.
The Board of Ethics was established by authority of Section 4-9 of the Town Charter and C.G.S. § 7-148. The Board is charged with the administration of the Code of Ethics set forth in Chapter 31 of the Town Code. The Board shall consist of five members appointed by the Board of Selectmen for four-year terms in accordance with Chapter 31 of the Town Code. Terms shall be staggered.
The Board of Fire Commissioners was established by authority of Section 4-8 of the Town Charter, Connecticut Special Act No. 349 approved August 8, 1945, entitled "An Act Concerning a Fire Department in the Town of Guilford," and C.G.S.§ 7-301. The Board shall consist of five members appointed by the Board of Selectmen for four-year terms in accordance with Section 4-8 and Section 4-2 of the Town Charter. Terms shall be staggered.
The Flood and Erosion Control Board was established by authority of C.G.S. § 25-84 and Chapter 42 of the Town Code. The Board shall consist of seven members, five of whom shall be members of the Board of Selectmen. The remaining two members shall be appointed by the Board of Selectmen for four-year terms following the election of the Board of Selectmen for a term consistent with the Board of Selectmen term.
A.
Establishment. The Guilford Green Committee was reactivated by the Board of Selectmen November 15, 1982, by authority of Section 4-12(c) of the Town Charter.
B.
Purpose. The purpose of the Committee is to advise the Board of Selectmen on policies for the use of the Town Green and any proposed improvements to the Town Green. The Committee shall further advise the Board of Selectmen on the use of gifts, bequests or other donations received by the Town for the benefit of the Town Green. Under the general supervision of the Board of Selectmen, the Committee shall be entrusted with the preservation of the current natural state of the Town Green and the monuments located thereon, in such a manner as to ensure that the Town Green remains the focal point of the Town.
C.
Appointment; term. The Committee shall consist of nine members appointed by the Board of Selectmen for four-year terms, in accordance with Chapter 4 of the Town Charter. Terms shall be staggered. In addition, the Parks and Recreation Director and Tree Warden shall be nonvoting members who shall serve as liasons to the Committee.
D.
Member representation. The Committee shall consist of one member at large and one representative from each of the following civic organizations: Guilford Foundation, Chamber of Commerce, Historic District Commission, Leete's Island Garden Club, Guilford Preservation Alliance, Guilford Keeping Society, Dorothy Whitfield Society and Guilford Garden Club.
The Guilford Lakes Golf Course Commission was established by authority of Chapter 45 of the Town Code. The Commission shall consist of seven members and two alternate members appointed by the Board of Selectmen for four-year terms in accordance with Chapter 45 of the Town Code. Terms shall be staggered.
The Harbor Management Commission was established by authority of C.G.S. § 22a-113k and Chapter 48 of the Town Code. The Commission shall consist of five members and two alternate members appointed by the Board of Selectmen for four-year terms in accordance with Chapter 48 of the Town Code. Terms shall be staggered. In addition, the state-appointed Harbormaster shall act as a nonvoting ex-officio member of the Commission.
The Hazard Mitigation Commission was established by authority of Chapter 50 of the Town Code in furtherance of the legislative goals and policies for coastal management set forth in C.G.S. § 22a-92. The Commission shall consist of seven members appointed by the Board of Selectmen for four-year terms in accordance with Chapter 50 of the Town Code. Terms shall be staggered.
The Historic District Commission was established by authority of C.G.S. § 7-147c and Chapter 187 of the Town Code. The Commission shall consist of five members and three alternate members appointed by the Board of Selectmen for five-year terms in accordance with C.G.S.§ 7-147c and Chapter 187 of the Town Code. Terms shall be staggered. At least three members and two alternate members shall reside within the Historic District, if any persons reside in the Historic District and are willing to serve on such Commission, as set forth in C.G.S. § 7-147c(d).
The Housing Authority was established by authority of C.G.S. § 8-40 and Chapter 52 of the Town Code and by Special Town Meeting held on January 31, 1967. The Authority shall consist of five commissioners appointed by the Board of Selectmen for five-year terms in accordance with C.G.S. § 8-41 and Chapter 52 of the Town Code. Terms shall be staggered. At least one commissioner shall be a tenant of the Authority as required by C.G.S. § 8-41(a). The term of the chairman of the Authority shall be three years as required by C.G.S. § 8-41(a).
The Housing Partnership was established by authority of C.G.S. § 8-336f and Chapter 56 of the Town Code. The Housing Partnership shall consist of the First Selectman, a representative from each of the Planning and Zoning Commission, Inlands Wetlands Commission, Housing Authority; three representatives of the local business community; two representatives from local public interest groups; and one representative from local urban planning, land use or housing professionals, all as more fully described in Chapter 56 of the Town Code and C.G.S. § 8-336f. Appointments to the Housing Partnership shall be made in accordance with C.G.S. § 8-336f. Members shall serve for four-year terms. Terms shall be staggered.
The Human Services Council was established by authority of Chapter 59 of the Town Code. The Council shall consist of no more than nine members appointed by the Board of Selectmen for three-year terms. The Director of Health shall be an ex officio member, without vote. Terms shall be staggered pursuant to the provisions of Chapter 59 of the Town Code.
The Inland Wetlands Commission was established by authority of C.G.S.§ 22a-42 and Chapter 64 of the Town Code. The Commission shall consist of seven members and three alternate members appointed by the Board of Selectmen for four-year terms. The regular members shall include a representative from the Planning and Zoning Commission and the Conservation Commission, respectively. Terms for those members serving on other commissions shall run concurrently with the term of their respective commissions. Terms shall be staggered pursuant to the provisions of Chapter 64 of the Town Code.
The Land Acquisition Commission was established by authority of Chapter 73 of the Town Code and C.G.S. § 7-148. The Commission shall consist of fourteen members appointed by the Board of Selectmen for four-year terms. The Commission shall consist of four at large members and one representative from each of the following: Conservation Commission, Planning and Zoning Commission, Inland Wetlands Commission, Economic Development Commission, Parks and Recreation Commission, Shellfish Commission, Water Pollution Control Authority, the Board of Education, the Scenic Roads Advisory Committee and the Agricultural Commission. Terms for those members serving on other boards and commissions shall run concurrently with the term of their respective boards and commissions. Terms shall be staggered pursuant to the provisions of Chapter 73 of the Town Code.
The Marina Commission was established by authority of Chapter 80 of the Town Code and C.G.S.§ 7-148. The Commission shall consist of five members and two alternate members appointed by the Board of Selectmen for four-year terms. Terms shall be staggered pursuant to the provisions of Chapter 80 of the Town Code.
The Parks and Recreation Commission was established by authority of Section 4-10 of the Town Charter, C.G.S. § 7-148 and Chapter 85 of the Town Code. The Commission shall consist of nine members appointed by the Board of Selectmen for four-year terms. Terms shall be staggered pursuant to the provisions of Chapter 85 of the Town Code.

A.
The Pension Committee was established by authority of an amendment to the Town of Guilford Employees' Pension Plan (Plan), as such Plan has been subsequently amended and restated as of January 1, 2013, and adopted by the Board of Selectmen on February 19, 2013, as the same may be amended and by authority of Section 4-12(c) of the Town Charter. The Pension Committee shall consist of not fewer than three nor more than five members appointed by the Board of Selectmen for four-year terms. Terms shall be staggered. The Plan sets forth the powers and duties of the Pension Committee.
B.
The Pension Committee also shall have responsibility for administering the Town of Guilford Police Retirement Fund (Police Retirement Fund) and the Town of Guilford Public School Employees' (Noncertified) Pension Plan [Public School Employees' (Noncertified) Pension Plan] and shall have the specific powers and duties with respect to the Police Retirement Fund and the Public School Employees' (Noncertified) Pension Plan, as set forth in the applicable plan document for the Police Retirement Fund and the Public School Employees' (Noncertified) Pension Plan.
C.
The Pension Committee shall administer the Town of Guilford 401(a) Defined Contribution Plan [the "401(a) Plan"] and such 457(b) Plan(s) as the Town from time to time may make available to its employees. Its authority shall include, but not be limited to, making recommendations to the Board of Selectmen to employ counsel, accountants, actuaries and any other professional consultants required for the purpose of administering the 401(a) Plan and the 457(b) Plan(s).

D.
Pursuant to § 88-7 of the Code of the Town of Guilford, the Pension Committee also shall serve as the OPEB Board, in accordance with § 88-8 of the Code of the Town of Guilford, and shall perform the duties of such OPEB Board as set forth in the OPEB Trust provided for in § 88-5 of the Code of the Town of Guilford, as amended from time to time.
The Board of Police Commissioners was established by authority of Section 4-7 of the Town Charter and C.G.S. § 7-148. The Board consists of five members appointed by the Board of Selectmen for four-year terms. Terms shall be staggered.
The Public Works Commission was established by authority of Section 4-11 of the Town Charter, Chapter 92 of the Town Code and C.G.S. § 7-148. The Commission consists of five members and two alternate members appointed by the Board of Selectmen for four-year terms. Terms shall be staggered pursuant to Chapter 92 of the Town Code.
The Scenic Roads Advisory Committee was established by the Board of Selectmen on March 3, 1997, by authority of Section 4-12(c) of the Town Charter. The Committee consists of eight members appointed by the Board of Selectmen for four-year terms. Terms shall be staggered. In addition, the Town Planner and the Town Engineer shall be nonvoting members who shall serve as liaisons to the Committee.
The Standing Building Committee was established by Town meeting on June 10, 1986, by authority of Section 4-12(c) of the Town Charter, for the purpose of overseeing and carrying out school or Town Building projects approved by Town meeting. The Committee consists of seven members and two alternate members appointed by Board of Selectmen for four-year terms. Terms shall be staggered pursuant to Town meeting in June 10, 1986.
The Standing Fields Committee was established by the authority of Section 4-12(c) of the Town Charter for the purpose of the implementation of the Town Master Plan for the improvement of Town and school playing fields, as such plan may be amended and restated from time to time. The Committee consists of nine members appointed by Board of Selectmen for four-year terms. One member shall be a representative from the Board of Education. The Parks and Recreation Director shall be a nonvoting member who shall serve as a liaison to the Committee. Terms shall be staggered.
The Transfer Station Advisory Committee was established by agreement between the Town of Guilford (executed June 6, 1983) and Town of Madison (executed July 5, 1983) concerning joint use of the Guilford transfer station, as such agreement may be amended and restated from time to time. An equal number of members shall be appointed by each town. The Guilford members shall be appointed by the Board of Selectmen for four-year terms. Terms shall be staggered. The Committee may be inactive for certain periods at the discretion of the Guilford and Madison Boards of Selectmen.
The Youth and Family Services Board was established by authority of Chapter 123 of the Town Code. The Board consists of nine members and two alternate members appointed by the Board of Selectmen for four-year terms. The Board may appoint up to four liaisons as described in Chapter 123 of the Town Code. Terms shall be staggered pursuant to Section 4-2(a) of the Town Charter.
The Zoning Board of Appeals was established by authority of Section 4-6 of the Town Charter and C.G.S.§ 8-5. The Board consists of five members and three alternate members appointed by the Board of Selectmen for four-year terms. Terms shall be staggered pursuant to Section 4-2(a) of the Town Charter.
Should any provisions of the Code be found with finality by a court of competent jurisdiction to be prohibited by the Connecticut General Statutes, the provisions of such statutes shall prevail.
