It is hereby declared that the purpose of this chapter is to protect
the public health, safety and general welfare and regulate the operation of
food service establishments which may adversely affect the public health,
safety and general welfare. It is further declared that in order to maintain
adequate protection of the public health, safety and general welfare, licensing
of food service establishments is required.
As used in this chapter, the following terms shall have the meanings
indicated:
FOOD SERVICE ESTABLISHMENT
Any place, fixed or mobile, where food or beverages are dispensed
or served to the public, as well as places in which food or beverages are
prepared for service or sale elsewhere to the public.
No person, firm or corporation shall operate or maintain a food service
establishment within the Town of Guilford until licensed by the Director of
Health. The Director of Health shall collect for each license such fee as
may be established from time to time by the Board of Selectmen.
The Director of Health or his/her authorized agent, who shall be a certified
food service officer, shall inspect the proposed food service establishment
and, if the establishment complies with the requirements of this chapter and
the Public Health Code of the State of Connecticut, shall issue a license
to the applicant upon payment of the annual fee. Such license shall be framed
and posted on the premises. No license shall be transferable, and such license
will be surrendered to the Health Department upon closing of the establishment.
The Director of Health shall revoke any license to operate a food service
establishment if the license holder does not comply with the requirements
of the Public Health Code of the State of Connecticut.
The operator of any food service establishment who fails to comply with
this chapter shall be fined not more than $99 for each day of such noncompliance.
