Outdoor aboveground fuel storage tanks and direct burial of single-wall in-ground fuel storage tanks are prohibited for all residential properties and, except as provided in Subsection B hereof, are prohibited for all commercial, industrial and municipal development.
Direct burial of double-wall tanks and burial of a tank
in a watertight concrete vault will be permitted where plans and specifications
are submitted to and approved by the Building Department/Fire Marshal.
Aboveground fuel storage tank placement in a suitable
watertight and weathertight enclosure may be permitted where plans and specifications
are submitted to and approved by the Building Department/Fire Marshal.
Direct burial of in-ground fuel storage tanks will be
permitted for commercial, industrial and municipal uses where storage tank
installations are designed and constructed in compliance with Connecticut
Department of Environmental Protection standards.
Residential use. Replacement of direct-burial in-ground and outdoor aboveground storage tanks for residential use will not be permitted. In-ground tanks and outdoor aboveground storage tanks must be replaced with storage tanks located in the basement, garage or otherwise as required in § 181-1A above.
Nonresidential use. Replacement of direct-burial in-ground storage tanks and outdoor aboveground storage tanks not regulated by the Connecticut Department of Environmental Protection will not be permitted. Direct-burial in-ground tanks and outdoor aboveground storage tanks must be replaced with storage tanks located in storage areas or other suitable watertight and weathertight enclosures or as otherwise required in § 181-1A above.
No fuel storage tank shall be installed or replaced in
the Town of Guilford except upon the issuance of a permit from the Guilford
Building Department. Application for such permit shall be made, in writing,
to the Building Department on forms prescribed by it and shall be accompanied
by the required permit fee, except when such permit is obtained in connection
with a building permit, in which case no fee additional to the building permit
fee shall be required.[1]
