A. 
No person shall launch or beach any jet ski or similar power vessel or other personal watercraft as the same may be defined by N.J.S.A. 12:7-34.37[1] or 12:7-62, or N.J.A.C. 7:6-9.2, or other applicable law (hereinafter "jet ski"), at any municipal waterfront location, including street ends, within the Borough of Beach Haven.

B. 
No person shall launch or beach any jet ski at the Taylor Avenue Park and swimming place.
C. 
No person shall launch or beach any jet ski on the ocean beaches in the Borough of Beach Haven except that beaching may be permitted in the event of a bona fide emergency requiring same.
D. 
Jet skis may be launched at the public boat ramp in the Borough of Beach Haven. The required launching fee shall be as established in Chapter 61, Boat Ramps, Municipal, of the Code of the Borough of Beach Haven.
A. 
No person shall operate a jet ski in such a manner so as to become airborne or completely leave the water while crossing the wake of another vessel within 100 feet of the vessel creating the wake.
B. 
A person operating a jet ski shall at all times proceed at a safe speed that shall allow the person operating the jet ski to take proper and effective action to avoid collision and to stop the jet ski within a safe distance, as may be appropriate under prevailing circumstances and conditions.
C. 
A person operating a jet ski shall not tow any water skier, raft, motorized vehicle or any other device.
D. 
A person shall not operate a jet ski within 50 feet of a bathing beach that has its boundaries marked by buoys or signs, nor with above idle or slow speed/no wake speed within 200 feet of shoreline, persons in the water, bridge, wharf, marina, dock or pier.
E. 
No person shall operate a jet ski during the hours between sunset and sunrise or during times of restricted visibility.
F. 
Any person operating a jet ski or any passenger thereon shall at all times when the jet ski is in operation or underway wear a United States Coast Guard approved type I, II, III or V Hybrid Personal Flotation device.
A. 
No person shall operate a jet ski:
(1) 
Or permit another to operate a jet ski while under the influence of an intoxicating liquor, narcotic, hallucinogenic or habit-producing drug or with a blood alcohol concentration of 0.10% or more by weight of alcohol.
(2) 
While transporting or containing on board any intoxicating liquor, narcotic, hallucinogenic or habit-producing drug.
(3) 
While consuming an intoxicating liquor, narcotic, hallucinogenic or habit-producing drug.
(4) 
In a reckless or negligent manner so as to endanger the life, limb or property of any person, or in any manner which unnecessarily interferes with the free and proper use of any waters, or which unnecessarily endangers other craft therein or the life or limb or any person upon such a craft or in the water.
(5) 
Or allow a jet ski to be operated in a manner where the speed of the power vessel, or its wake, may cause danger of injury to life or limb or damage to property, or otherwise in violation of N.J.S.A. 12:7-45 and N.J.A.C. 7:6-1.31.
(6) 
In a manner which shall unreasonably interfere with other vessels or with free and proper navigation of the waterways, anchor in heavily traveled channels or main thoroughfare, or tie up or anchor in navigable channels in such a manner as to prevent or obstruct the passage of other vessels or craft, or carelessly sink or permit or cause to be sunk or except in an emergency voluntarily sink or cause to be sunk a vessel or other craft in a navigable channel.
(7) 
In violation of the noise limitation provisions of N.J.A.C. 7:6-6.3 and 6.4 and/or local ordinances.
B. 
No person operating a jet ski shall fail to stop or lay to when ordered to do so by any marine patrolman or other law enforcement officer.
C. 
The operator of a jet ski shall not allow any persons to ride in any condition that would unduly endanger life or limb or cause danger of falling overboard.
D. 
No jet ski shall be operated unless displaying the number assigned to it and the certificate of number shall at all times be available for inspection pursuant to N.J.S.A. 12:7-34.38 et seq.
E. 
No person 16 years of age of younger shall operate a jet ski without having completed a boat safety course pursuant to N.J.S.A. 12:7-61 and N.J.A.C. 13:61-1.1 et seq. Any such person shall have in his or her possession a certificate certifying the successful completion of the boat safety course. Failure of the person to exhibit the certificate is presumptive evidence that the person has not completed an approved boat safety course.
The provisions of this article may be enforced by the Marine Police of the Division of State Police, and other state, county and local law enforcement officials within the jurisdiction of Beach Haven; said violations being heard in the Municipal Court of the Borough of Beach Haven.
A penalty for violation of any portion of this article shall be as set forth as provided in the New Jersey Statutes Annotated, regulations promulgated thereunder, or by applicable ordinance penalties, as the case may be.

The Council of the Borough of Beach Haven may adopt such further rules and regulations pertaining to the operation of jet skis by resolution as may be deemed necessary.
