No person shall start, kindle, allow or maintain any fire on
the exterior of any building within the Borough of Beach Haven on
either public or private property except as specifically authorized
by this section.
A. Permitted
outdoor fires:
(1) Outdoor
fires where charcoal, dry, clean, untreated wood or other fuels designed
for use in outdoor grills, traditional outdoor food cooking devices,
outdoor fireplaces or chiminea which are constructed of metal, concrete,
brick, earth or other nonflammable substance and which are specifically
designed to contain burning are permitted.
(2) Paper
or petroleum products in limited amounts may be used only for ignition
purposes.
(3) Fires permitted pursuant to a validly issued permit issued pursuant to §
55-3 of the Code of the Borough of Beach Haven.
(4) All
permitted fires must be attended at all times until they are completely
covered and enclosed or completely extinguished.
B. Violations. Anyone starting or maintaining a fire in the Borough of Beach Haven other than on the interior of a building except as hereinabove permitted in Subsection
A shall be subject to the penalties provided for in §
1-16 of the "Code of the Borough of Beach Haven, County of Ocean, State of New Jersey, (2000).
C. Each starting, kindling, causing or allowing of a fire except as permitted in Subsection
A above shall be considered a separate violation and offense under this section.
D. This section
may be enforced by the Code Enforcement Officer of the Borough of
Beach Haven and also may be enforced by members of the Beach Haven
Police Department.
No person shall deposit hot ashes or cinders,
or smoldering coals, or greasy or oily substances liable to spontaneous
ignition, into any combustible receptacle, or place the same within
10 feet of any combustible materials, except in metal or other noncombustible
receptacles. Such receptacles, unless resting on a noncombustible
floor or on the ground outside the building, shall be placed on noncombustible
stands, and in every case must be kept at least two feet away from
any combustible wall or partition.
Accumulations of wastepaper, hay, grass, straw,
weeds, litter or combustible or flammable waste or rubbish of any
kind shall not be permitted to remain upon any road or in any court,
yard, vacant lot or closed or open space. All weeds, grass, vines
or other growth, when same endanger property or are liable to be fired,
shall be cut down and removed by the owner or occupant of the property
they are is on.
All chimneys, smokestacks or similar devices
for conveying smoke or hot gases to the outer air and the stoves,
furnaces, fireboxes or boilers to which they are connected shall be
constructed and maintained in such a manner as not to create a fire
hazard.
