A certain document, three copies of which are on file in the office of the Municipal Clerk of the Borough of Beach Haven, in the County of Ocean, State of New Jersey, being marked and designated as the "International Property Maintenance Code 2009" as published by the International Code Council, be and is hereby adopted as the property maintenance code of the Borough of Beach Haven, in the County of Ocean, State of New Jersey, for the control of buildings and structures as herein provided, and each and all of the regulations of the International Property Maintenance Code 2009 are hereby referred to, adopted and made a part hereof as if fully set forth in this article.

The following sections of the International Property Maintenance Code 2009 are hereby revised and changed as follows:
A. 
The name "Borough of Beach Haven" shall be inserted in the second sentence of Section ES-101.1 on page 1 of the code.
B. 
Section ES-106.4 entitled "Penalty" be and is hereby amended to read as follows:
ES-106.4 Penalty: Any person, firm or corporation who shall violate any provision of this code, upon conviction thereof, shall be subject to a fine of not less than $100 nor more than $1,000 or to imprisonment for a term not to exceed 90 days, or both, at the discretion of the court. Each day that a violation continues after due notice has been served, in accordance with the terms and provisions hereof, shall be deemed a separate offense.

Nothing in this article or the BOCA National Existing Structures Code/1987, Second Edition, hereby adopted, shall be construed to affect any suit or proceeding pending in any court or any other rights acquired or liability incurred or any cause or causes of action acquired or existing under any act or ordinance hereby repealed, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this article.
