Cluster subdivision development may apply to lots in which the overall density of housing development is maintained to a maximum of one dwelling per acre, and the difference in the land area between the individual dwelling lots and streets and the total area of the development is dedicated as common open space, including recreation facilities, or for public facilities servicing the neighborhood and owned either by the Borough or by a neighborhood association established on an automatic basis upon the sale of the residential lots and composed of the owners of the lots. This provision applies only to residential developments processed under the terms of the Subdivision Ordinance of the Borough[2] and applies only where the common open space or public facilities areas are determined by the Planning Board to be desirable, necessary and appropriate. The number of lots to be developed shall be determined by the Planning Board after the applicant has submitted a sketch plat for subdivision under the R-44 zoning provisions. The maximum number of lots permitted shall not be greater than the number of lots otherwise permitted pursuant to major subdivision approval in an R-44 application.
