A. 
Smoking shall be prohibited in all retail establishments where meat, fruits, vegetables or baked goods are available or displayed for retail purchase, other than for consumption of such products on the premises.
B. 
For purposes of this article smoking is defined as:

(1) 
The combustion of any tobacco or tobacco-type product, including, but not limited to, cigarettes, cigars, and pipes; and
(2) 
The use of any device to inhale vapor through the mouth from an electronic device that heats up and vaporizes a liquid or solid, including, but not limited to, devices commonly known as electronic cigarettes.
The prohibition set forth in § 341-1 above shall apply to both customers and personnel of such retail establishment; provided, however, that the operator of such establishment may provide a separate area, where such food items are not sold, displayed or stored, for its employees who wish to smoke, and that smoking in such an area by employees shall not be considered a violation of this Article.
Any person who shall violate the prohibition set forth in § 341-1 shall, upon conviction, be subject to a fine not exceeding five hundred dollars ($500.) for each and every offense. It shall be considered a violation of this Article to either smoke in a prohibited area or to knowingly permit smoking in a prohibited area.
The provisions of this Article may be enforced by any member of the Police Department, the Health Officer or Health Inspector of the Borough of Ridgefield.

For purposes of this article, smoking is defined as:
A. 
The combustion of any tobacco or tobacco-type product, including, but not limited to, cigarettes, cigars, and pipes; and
B. 
The use of any device to inhale vapor through the mouth from an electronic device that heats up and vaporizes a liquid or solid, including, but not limited to, devices commonly known as electronic cigarettes.
Any person violating the provisions of this article shall be subject, upon conviction, to a fine not exceeding $500 and/or to a period of community service not to exceed 30 days.
The provisions of this article may be enforced by any member of the Borough Police Department, or other officer or inspector, of the Borough of Ridgefield.

Items and devices capable of being used for smoking, as that term is defined in § 341-5 above, including, but not limited to, cigarettes, cigars, pipes and electronic cigarettes, may not be sold by and within the confines of the Borough of Ridgefield to persons under the age of 21 years.
