A. 
The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of temporary emergency no-parking signs when weather conditions, accidents, fires, public celebrations or any other condition or conditions would create a situation where the parking of vehicles would interfere with the free flow of traffic or which would hinder and/or obstruct the municipal authorities in the performance of their necessary functions and duties in reducing or preventing hazards caused thereby.
B. 
Upon the declaration of an emergency, there shall be no parking upon streets, or sections of streets, where temporary emergency no-parking signs are displayed.
C. 
The posting of emergency no-parking signs shall be deemed to be notice to the owner and operator of said vehicle. Notification that the emergency no-parking signs are being, or will be, posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
Any occupied or unoccupied vehicle parked in violation of this article shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.
The signs to be used, as above set forth, shall conform with the regulations of the Traffic Safety Service, New Jersey Division of Motor Vehicles.

Any person found guilty of violating this article of the Code of the Borough of Ridgefield shall be subject to a penalty consisting of fine or imprisonment, or both, subject to the discretion of the Judge, the maximum of which shall be the maximum fine or term of imprisonment permitted to be imposed by the court having jurisdiction over the violation of this article of the Code of the Borough of Ridgefield; provided, however, that the fine shall not be less than $100 nor more than $2,000 per offense and the prison term shall not exceed 90 days in accordance with N.J.S.A. 40:49-5. Due consideration shall be given to scheduled mandatory fines for comparable motor vehicle offenses pursuant to N.J.S.A. 39:1-1 et seq.
