Parking of commercial vehicles, as hereinafter defined, on all
streets in the Borough of Ridgefield between the hours of 9:00 p.m.
and 6:00 a.m. is hereby prohibited.

Commercial vehicles owned, leased, or associated to a registered
business in a commercially zoned area in the Borough Ridgefield will
be permitted to park on municipal streets during the prohibited hours.
Any vehicle parked in this condition shall be properly identified
with the business name clearly and permanently affixed to the exterior
of the vehicle. Window stickers, interior placards or magnets of any
type will not be an acceptable means of identification. Any commercial
vehicle related to the active business must be parked within 50 feet
of the registered business.
For purposes of this article, the following
terms shall have the meanings indicated:
COMMERCIAL VEHICLE
A.
Any truck, being any motor vehicle designed
and used or maintained primarily for the transport of property.
B.
Any boat trailer, utility trailer, camper-type
trailer of self-propelled camper or recreational vehicle, whether
or not affixed or connected to another motor vehicle.
C.
Any van or pickup truck bearing commercial license
plates or having any sign, lettering, exterior racks intended for
transportation or storage of equipment, or other indicia indicating
that the vehicle is maintained for business or commercial purposes.

E.
Buses of all types, including, but not limited
to, school buses and mini school buses.
I.
Camper vehicles, motor homes and mobile homes.
J.
Commuter vans or other commuter vehicles.
L.
All dump trucks regardless of size.
N.
All nonpassenger vehicles and/or equipment or
machinery, including but not limited to construction vehicles and
equipment.
Upon application to the Chief of Police, or
his designee, limited exemptions, for periods no longer than 10 days,
shall be given for temporary visitors or guests and construction equipment
in use at an existing work site.
Exempt from provisions of this article are any
motor vehicles owned by the Borough of Ridgefield or any agency or
department thereof.

No person shall service a commercial vehicle on any street within
the Borough of Ridgefield at any time. Servicing of commercial vehicles
shall include washing, cleaning, performing of mechanical repairs
or maintenance, and performing of auto body repairs or maintenance.
Servicing of commercial vehicles on Borough streets in emergency situations,
where a commercial vehicle has broken down and is receiving emergency
servicing for the purpose of removing it from the place of breakdown
to a garage or repair facility shall be permitted and must be done
in a timely manner and not impeded normal traffic flow. A commercial
vehicle is not permitted to be parked overnight on a municipal street
for the purposes of servicing the next day and will be considered
a violation of this section.

A. Any person found guilty of violating this article
of the Code of the Borough of Ridgefield shall be subject to a penalty
consisting of a fine or imprisonment, or both, subject to the discretion
of the Judge, the maximum of which shall be the maximum fine or term
of imprisonment permitted to be imposed by the court having jurisdiction
over the violation of this article of the Code of the Borough of Ridgefield;
provided, however, that the fine shall not be less than $100 nor more
than $2,000 per offense and the prison term shall not exceed 90 days
in accordance with N.J.S.A. 40:49-5.
B. In the event of a continuing violation, each day shall
constitute a separate offense.
C. Each vehicle which is parked in contravention of the provisions of
this article shall constitute a separate offense.
