The purpose of this article is to establish
certain areas of private property that are open to the public or to
which the public is invited that shall prohibit parking in areas designated
as "handicapped parking places" for use by persons who have been issued
special identification cards by the Division of Motor Vehicles. No
other persons shall be permitted to park in these spaces.
This Article is enacted in accordance with N.J.S.A.
40:48-2.46 which does confer upon the Borough the right to establish
handicapped parking spaces in order to preserve and safeguard the
public health, safety, morals and welfare.

Any person found guilty of violating this article
of the Code of the Borough of Ridgefield shall be subject to a penalty
consisting of a fine or imprisonment, or both, subject to the discretion
of the Judge, the maximum of which shall be the maximum fine or term
of imprisonment permitted to be imposed by the court having jurisdiction
over the violation of this article of the Code of the Borough of Ridgefield;
provided, however, that the fine shall not be less than $100 nor more
than $2,000 per offense and the prison term shall not exceed 90 days
in accordance with N.J.S.A. 40:49-5. Due consideration shall be given
to scheduled mandatory fines for comparable motor vehicle offenses
pursuant to N.J.S.A. 39:1-1 et seq.
