The Commissioner and/or Deputy Commissioner
in charge of gardens shall have jurisdiction to regulate and control
the botanical plantings and related maintenance and operation of gardens,
botanic gardens and bird sanctuaries whether the same is now or hereafter
owned or acquired by the Town of North Hempstead in fee or otherwise,
including all land under and space above the surface of the ground.
The rules and regulations, as well as penalties,
set forth in this chapter for Town parks shall apply to all gardens,
botanic gardens and bird sanctuaries. The Commissioner shall adopt
any additional or unique rules and regulations governing the use and
operation of all gardens, botanic gardens and bird sanctuaries subject
to the approval of the Town Board.
