It shall be unlawful for any person to bathe,
wade, swim or enter into the waters adjacent to any Town park or beach
except at such times and in such areas as are designated by the Commissioner.

Use of Town parks shall be restricted to residents
of the Town unless otherwise provided in a fee schedule approved by
the Town Board. Where so required by the Commissioner, all persons
entering any park will be required to present an official identification
pedestrian entrance permit to be issued by the Commissioner. Use of
special district pools shall be restricted to residents of the district.
In addition to the rules and regulations which
may be adopted by the Town Board by resolution, the following rules
and regulations are applicable generally to pools and related facilities
in the Town:
A. Procedure to be followed in issuance of official identification.
All persons who desire to use the facilities of a pool located within
a park of the Town of North Hempstead shall first file with the Commissioner
a written application upon forms to be furnished by the Commissioner
containing the following information:
(1) The name and address of the applicant.
(2) The applicant's telephone number if the applicant
has a telephone.
(3) The section, lot and block number of realty owned
by the applicant shown on the Official Map of the County of Nassau,
or must establish that the applicant is a legal resident of the Town
for the past three months.
(4) If the applicant is a married person, the first name
of the wife or husband and the first name of all unmarried children
in the applicant's family, together with the age of each child so
named. If the Commissioner shall find from the statements contained
in the application for official identification that the applicant
is entitled to the use of such facilities of the pool area applied
for, then the Commissioner shall issue to said applicant official
identification; otherwise such application shall be denied.
B. Regulations governing the use of Town and special
district pools.
(1) No person shall be permitted to enter the pool if,
in the opinion of the lifeguard in charge, conditions therein are
unsafe for bathing or swimming, and bathing or swimming shall be considered
safe only when and during the hours lifeguards are on duty. Such hours
shall be posted within the pool area.
(2) No person shall be admitted into the pool except attired
in bathing costume. Shoes must be removed before entering the pool
area.
(3) All persons with hair over four inches in length must
wear bathing caps in the water.
(4) All bathers must take a soap-and-water shower before
entering the pool.
(5) The Commissioner may designate those pool areas and
other facilities where smoking is or is not permitted for reasons
of public health and safety. There shall be no smoking within the
areas so designated.
(6) The Commissioner may designate those areas where,
in the interest of public safety, diving is not permitted. There shall
be no diving in those areas so designated. Diving shall be permitted
from diving boards. No more than one person shall be permitted on
any diving board at the same time. Divers must not bounce the diving
board unnecessarily. Divers using boards must swim to and leave the
pool by ladders.
(7) All individuals using the facilities of any Town or
special district pool shall abide by all of the rules and regulations
governing the use of Town parks.
(8) It shall be unlawful for any person to use suntan
lotions and other oils; use toys, play equipment, flotation devices,
swim fins, masks, glasses or snorkels; have basket parties and/or
picnics, bottles, containers or any glassware, food, beverages, candy
or chewing gum; or engage in pushing, running, ducking or boisterous
conduct.
(9) The Commissioner may designate the hours when, in
the interest of public safety, the pools may be opened and closed.
The pools shall be opened and closed at the times so designated. The
opening and closing time shall be posted in the pool area.
(10) The Commissioner may designate the maximum number
of persons permitted in the pools consistent with public safety. There
shall be no persons admitted in excess of the maximum so designated.
The maximum number permitted in the pool shall be posted in the pool
areas.
C. Revocation of official identification. Any false statement
contained in the application for official identification, any violation
of any of the rules and regulations governing the use of the pool
area or any alteration made to the official identification shall constitute
grounds for revocation of the official identification by the Commissioner
or his officially authorized representative. If any official identification
shall be revoked, there will be no refund of the fee paid.

Lockers at the parks of the Town of North Hempstead,
at the discretion of the Commissioner, may be rented by individuals
using the facility at the rates as designated by resolution of the
Town Board.
