This chapter shall provide for the method of administration and enforcement of the New York State Uniform Fire Prevention and Building Code. This chapter is to be administered and enforced by the Board of Trustees of the Village of Rouses Point and the authorized and designated representatives and officials of the said Board of Trustees as provided for in this chapter.
A. 
Definitions. Unless the context specifically indicates otherwise, the meanings of terms used in this chapter shall be as follows:
ARCHITECT
An architect licensed by the State of New York Education Department.
BOARD OF TRUSTEES
The Mayor and Board of Trustees of the Village of Rouses Point.
BUILDING
(1) 
For the purpose of all articles of this chapter except for Article VII, a structure occupying an area greater than 100 square feet consisting of a wall, roof and floor, or any one or more of them, or a structural system serving the function thereof, including all the works, fixtures and service systems appurtenant thereto, and includes such other structures as are designated in the regulations,[1] except a nonresidential farm building.
(2) 
For the purpose of Article VII of this chapter, includes any man-made structure, edifice or erection composed of any substance, whether intended to be temporary or permanent in nature and regardless of whether or not the same is used for habitation, shelter or storage or for any purpose whatever and regardless of whether the same is or is not composed of four walls and a roof or foundation and floor.
CHIEF OFFICIAL
The Chief Uniform Fire Prevention and Building Code Enforcement Official appointed, pursuant to the provisions of this chapter, and having jurisdiction for the enforcement of this chapter.
CODE
The Uniform Fire Prevention and Building Code.
CONSTRUCT
To do anything in the erection, installation or extension or material alteration or repair of a building and includes the installation of a building unit fabricated or moved from elsewhere, and "construction" has a corresponding meaning.
DEMOLITION
The doing of anything in the removal of a building or any material part thereof.
INSPECTOR
An Inspector appointed, pursuant to the provisions of this chapter, and having jurisdiction for the enforcement of this chapter.
MUNICIPALITY
The Village of Rouses Point or the Village of Champlain or the Town of Champlain or such other governmental unit as set forth in this chapter.
PROFESSIONAL ENGINEER
An engineer licensed by the State of New York Education Department.
SOLID-FUEL-BURNING APPLIANCE
Any of the following:
(1) 
Wood or coal stoves.
(2) 
Fireplaces.
(3) 
Wood or coal furnaces.
(4) 
Wood- or coal-fired furnaces.
(5) 
Any other apparatus which may utilize wood, coal or other solid material as a fuel.
STRUCTURE
Includes any natural or man-made condition or result, being either built up or piled up, eroded, excavated or caved in. The term shall also include any condition or production of work comprised of one or more pieces or parts built up or joined together in some definite manner or which was previously built up or joined in some manner.
UNSAFE
 When used in respect to a building:
(1) 
Structurally inadequate or faulty for the purpose for which it is used:
(2) 
In a condition that is or could be hazardous to persons in the normal use of the building; or
(3) 
In a condition that is dangerous or hazardous to the public.
VILLAGE
The Village of Rouses Point.

B. 
Word usage. "Shall" is mandatory; "may" is permissive, as used in this chapter.
A. 
The Board of Trustees of Rouses Point is responsible for the enforcement of this chapter in the Village of Rouses Point.
B. 
There are hereby created the positions of Chief Fire Code Official and Fire Code Inspectors for the enforcement of this chapter. The Mayor and the Board of Trustees shall appoint such Chief Official and such Inspectors as are necessary for the purposes of the enforcement of this chapter in the Village of Rouses Point.
C. 
The Board of Trustees of the Village of Rouses Point may enter into an agreement with any other municipality for or regarding the following, pursuant to the provisions of Article 5-G of the General Municipal Law:
(1) 
Providing for the joint enforcement of this chapter with similar local laws adopted by the respective neighboring municipalities for their respective jurisdictions.
(2) 
Providing for the sharing with other municipalities of costs incurred in the enforcement of this chapter and similar local laws of the other respective municipalities.
(3) 
Providing for the appointment of a Chief Official and Inspectors.
D. 
The Clerk of the Village of Rouses Point shall issue a certificate of appointment bearing his signature or a facsimile thereof to the Chief Official and each Inspector appointed by the Village who shall reproduce the certificate upon request in the performance of his duties required by this chapter as may be.
