Pursuant to the provisions of the Borough Code, a Shade Tree Commission is hereby created and established for the Borough of Hanover.
The Shade Tree Commission shall be composed of three residents of the Borough of Hanover, who shall be nominated by an appropriate committee of the Borough Council, appointed by the Mayor and approved by the Borough Council.
The members of the Shade Tree Commission shall serve without compensation, and vacancies in such Commission occurring other than by expiration of term shall be filled for the unexpired term in the same manner as original appointments.
The members of the Shade Tree Commission shall serve for terms of five years, or until their successors are appointed, except that the terms of the members of such Commission first appointed shall be one member for a term of three years, one for a term of four years and one for a term of five years.
The Shade Tree Commission shall have exclusive custody and control of the shade trees within the right-of-way lines of the public streets and highways in the Borough of Hanover.
The Shade Tree Commission is authorized to plant, remove, maintain and protect shade trees within the right-of-way lines of the public streets and highways in the Borough of Hanover.
The members of the Shade Tree Commission shall elect their own Chairman and Secretary and select all other necessary officers.
The Shade Tree Commission may employ and pay such superintendents, engineers, foresters, tree wardens or other assistants as the proper performance of the duties devolving upon it shall require, within the limits of the appropriation made by the Borough Council for such purposes.
The Shade Tree Commission may make, publish and enforce regulations for the care and protection of the shade trees within the right-of-way lines of the public streets and highways in the Borough of Hanover. No such regulation shall be in force until it has been approved by the Borough Council and until it has been published two times in a newspaper of general circulation published in the Borough of Hanover.
The Shade Tree Commission shall annually report in full to the Borough Council its transactions and expenses for the last fiscal year of the Borough.
