Sweeping, raking, blowing or otherwise placing
yard waste that is not containerized at the curb is only allowed during
the seven days prior to a scheduled and announced collection, and
shall not be placed closer than 10 feet from any storm drain inlet.
Yard waste cannot be placed in the public street and/or public sidewalk
and shall be placed for pickup in a location as close to the public
street as practicable. Placement of such yard waste at the curb or
along the street at any other time or in any other manner is a violation
of this article. If such placement of yard waste occurs, the party
responsible for placement of the yard waste must remove the yard waste
from the street or said party shall be deemed in violation of this
article.
It shall be unlawful for any property owner
and/or property occupant to place leaves, tree trimmings, bush trimmings,
landscape trimmings, rubbish, or trash of any kind in the gutter or
between the curbs of any public thoroughfare or on the sidewalks of
the Borough of Haddonfield, except such may be placed on the 1/3 portion
of such sidewalk nearest the abutting curb where no grass strip exists
between the sidewalk and the curb. The property owners and/or property
occupants shall be charged if this section is violated.
It shall be unlawful for any person or persons,
corporation or corporations to place or to cause to be placed such
leaves, rubbish or trash (exclusive of tree trimmings) on said 1/3
portion of any such sidewalk unless the same shall be securely tied
together in bundles or placed in containers in such manner that the
same will not become scattered over the sidewalk or street; provided,
however, that any such container and its contents shall not exceed
60 pounds in weight.
As used in this article, the following terms
shall have the meanings indicated:
CONTAINERIZED
The placement of yard waste in a trash can, bucket, bag or
other vessel, such as to prevent the yard waste from spilling or blowing
out into the street and coming into contact with stormwater.
PERSON
Any individual, corporation, company, partnership, firm,
association, or political subdivision of this state subject to municipal
jurisdiction.
SIDEWALK
The space between the curb along the side of any street or
avenue and the front or street line of the abutting lot.
STREET
Any street, avenue, boulevard, road, parkway, viaduct, drive,
or other way, which is an existing state, county, or municipal roadway,
and includes the land between the street lines, whether improved or
unimproved, and may comprise pavement, shoulders, gutters, curbs,
sidewalks, parking areas, and other areas within the street lines.
Violations of any of the provisions of this article shall be punishable as provided in Chapter
1, General Provisions, §
1-14. Each day during which such violation shall be continued shall be deemed and taken to be a separate and distinct offense.
