The Mayor and Council of the Borough of Maywood
have established a reputation for public service with the highest
standards of integrity. In order to maintain this reputation, it discourages
any practice which might reflect unfavorably either upon itself or
its staff.
The Borough policy forbids any employee:
A. To offer gifts or gratuities of any kind to any individual
or organization with whom we do business or are likely to do business;
B. No Borough employee shall seek, solicit, receive or
accept any gift, regardless of its value, from any person, firm or
corporation, which is offered by reason of, or likely to have been
offered by reason of or likely to have been offered by reason of the
position of the employee. This section shall not apply where the gift
is made as a promotion in the usual course of business, nor to prohibit
the acceptance of a salary by said employee for actual work performed.
C. To accept cash discounts on merchandise or services
obtained in any way connected with his or a colleague's employment
as a Borough employee (except for discounts granted to employee organizations
or other formal groups).
D. To accept any favors, such as entertainment, meals,
transportation, etc., either free or at reduced rates which might
tend to obligate the employee to any individual or organization with
whom we do business or are likely to do business.
It is recognized that there may be rare occasions
when employees are offered tokens of trifling value, when public transportation
or meals are not available, or when the best interests of the Borough
require that this policy be varied. Furthermore, nothing contained
herein shall be deemed to prohibit employees from giving or receiving
gifts in connection with birthdays, anniversaries or recognized holidays,
provided such gifts are not intended to influence official action.
The Mayor and Council have delegated to the Borough Administrator
the responsibility for advising as to the circumstances under which
variations to this policy are justified. In the absence of previous
guidance, an employee should clear through his department head, Borough
Administrator before giving or accepting any article, discount or
other favor. This instruction is not to be construed as restricting
the distribution of Borough informational material. Finally, it is
not intended to prevent the entertainment of Borough guests, where
this is the normal business practice and it does not conflict with
the policy of the employer of the outside person involved.
