As used in this chapter, the following terms shall have the meanings indicated:
STREETLAMP
Any illuminating apparatus installed on any public or private property at the cost to or operating cost of the Borough of Maywood.
A. 
It shall be illegal for any person, firm or corporation to request of any utility or other entity the installation of a streetlamp without first receiving, in writing, the approval of the Borough of Maywood Mayor and Council.
B. 
All utilities or other entities are prohibited from installing a streetlamp at the request of any private individual, firm or corporation without first receiving, in writing, the approval of the Borough of Maywood Mayor and Council.
C. 
This chapter shall not apply to any streetlamp installed pursuant to an application to the Borough of Maywood Building Department or an application made before the Borough of Maywood Land Use Board.
D. 
The installation of any streetlamp by the direction of any governmental entity or unrequested independent determination of a utility is exempt from this chapter.
The request for a streetlight change shall include the following information:
A. 
An application provided by the Borough and completed by the petitioner;
B. 
An identification of the public way and the pole on which the requested streetlight would be installed;
C. 
A description of the situation demonstrating the need for a streetlight.
The Mayor and Council shall review the request and evaluate same within their sole discretion.
Any person, firm or corporation convicted of a violation of any provision of this chapter shall be subject to a fine of not more than $1,000. Each streetlamp installed without approval in violation of the terms hereof shall be deemed a separate offense.
