No railroad, corporation or person owning or operating any railroad
line, locomotive, railroad train or crossing gate within the Borough of Maywood
nor any employee thereof shall operate or suffer or permit the operation of
any locomotive, train or crossing gate in such a manner as to prevent or interfere
with the use of any street within the Borough of Maywood for the purpose of
travel longer than is necessary for the passage of a train or locomotive,
but in no event for a continuous period of five minutes, except by reason
of circumstances over which the railroad, corporation or person owning or
operating such railroad line, locomotive, railroad train or crossing gate
or employee thereof has no control. Such exception is an affirmative defense
which must be proved by a preponderance of the evidence.
Unless another penalty is expressly provided by New Jersey statute,
every person convicted of a violation of a provision of this chapter or any
supplement thereto shall be liable to a penalty of not more than $1,000 or
less than $100 or imprisonment for a term not exceeding 90 days, or both.
