A. Permit required. Any person, firm or corporation shall
obtain a permit from the County Roads Engineer prior to opening the
surface of any road, street or public thoroughfare.
B. Application; fees; insurance. Each application shall
be on forms prescribed by the County Roads Engineer and accompanied
by a fee of $2 for each opening. In addition, when applicable, each
application shall be accompanied by an additional application fee
of twenty cents ($0.20) for each additional square foot of surface
opening in excess of 12 square feet. All applicants shall furnish
the County Roads Engineer with a memorandum copy of an insurance policy
in current force covering public liability.
C. Issuance. The County Roads Engineer shall grant a
permit to any applicant to open the surface of any street, road or
public thoroughfare if the County Roads Engineer determines that:
(1) The opening is for the purpose of installing or repairing
water pipes, sewer lines, gas lines, telephone cables or electrical
cables.
(2) The applicant has sufficient insurance to cover any
liability to the public which may arise out of the openings.
(3) The opening will not be unduly hazardous to the traveling
public.
D. Waiver of permit. The County Roads Engineer may waive
the requirement for a permit under this Article if the person who
desires to open the surface of a street or road has obtained a permit
from the City Engineer for the City of Cambridge.
E. Exemption – broadband projects. Broadband projects are exempt from the payment of the square foot surface openings in the surface of any road, street or thoroughfare, as set forth in §
40-14B. Broadband projects are not exempt from the payment of the established permit fee. Broadband projects are not exempt from the other provisions of §
40-14 of Chapter
40 of the Dorchester County Code.

A. Backfilling and resurfacing procedures; time limit.
All openings which are made in streets shall be backfilled by compacting
the bank-run gravel in layers, not over eight (8) inches in depth,
with a hand tamper, a mechanical vibrating tamper or a pneumatic tamper
and shall comply with applicable rules and regulations of the County
Roads Engineer. After placing the fill, the person opening the surface
of the street or road shall pave the opening with an approved cold-mix
patch material two inches in thickness. All of the aforesaid work
shall be completed within four days from the time the digging of the
hole was first begun, unless the person opening the surface of the
street or road obtains a new permit from the County Roads Engineer.
For a period of 30 days after the completion of work, the person opening
the surface of the street or road shall be required to make such repatches
as may be necessary to keep the street or road in a good condition.
B. Permanent repairs. In addition to the above, permanent repairs shall be made by the person who has opened the street or road if the surface of the street or road opened consists of concrete, bituminous concrete or brick with a concrete base, and these repairs shall be made within 60 days after the street opening, unless, for good cause, the County Roads Engineer extends the time. The repairs shall be made in accordance with the rules and regulations of the County Roads Engineer, and all brick streets shall be repaired with concrete brought flush with the surrounding brick surface. On any street for which the person who has opened the street or road is required to make permanent repairs as set forth in this subsection, he shall be responsible for keeping the temporary repairs set forth in Subsection
A above in good condition until such time as the permanent repairs are completed.

The County Roads Engineer may make all rules
and regulations necessary to assure that openings of surfaces of streets
and roads will not constitute a hazard to the traveling public and
that all repairs of openings of road and street surfaces will restore
the streets to their original condition.

Any person who opens the surface of any street or road without first obtaining a permit or who willfully and knowingly violates any of the provisions of §§
40-14 and
40-15 of this article shall be guilty of a misdemeanor and, upon conviction, shall be subject to a fine of not more than $1,000.
