No site plan or preliminary plat shall be granted approval unless it includes a soil erosion and sediment control plan in accordance with the "Standards and Specifications for Soil Erosion and Sediment Control" of the United States Department of Agriculture, Soil Conservation Service, as adopted by the Northeast Jersey Soil Conservation District. No approval for occupancy of any building will be granted unless all needed soil erosion control measures have been completed or substantially provided for in accordance with this chapter. The developer shall bear the final responsibility for the installation and construction of all required soil erosion and sediment control measures according to the provisions of this chapter.
The developer must submit a soil erosion and sediment control plan for the entire tract of land. The soil erosion and sediment control plan shall contain:
A. 
Plans and specifications of soil erosion and sediment control measures in accordance with the "Standards and Specifications for Soil Erosion and Sediment Control" of the United States Department of Agriculture, Soil Conservation Service, as adopted by the Northeast Jersey Soil Conservation District.
B. 
A timing schedule indicating the anticipated starting and completion dates of the development sequence and the time of exposure of each area prior to the completion of effective erosion and sediment control measures.
A. 
No land shall be cleared, graded, transported or otherwise disturbed for purposes including, but not limited to, the construction of buildings, the mining of minerals or removal of other natural resources, the development of golf courses and the construction of roads and streets, by any private person, partnership, corporation or municipal corporation within this municipality, unless:
(1) 
There has been a plan approved by the Planning Board that provides for minimizing soil erosion and sedimentation consistent with this chapter, and
(2) 
There has been a valid grading permit issued by the designated official, or
(3) 
There has been a determination by the Planning Board or its duly authorized representative that a plan for minimizing soil erosion and sedimentation is not necessary, or
(4) 
There have been soil removal permits issued as required by applicable borough ordinance[1] except as exempted by Article V.

B. 
Application. A separate application shall be required for each grading permit. Plans, specifications and timing schedules shall be submitted with each application for a grading permit. The plans shall be prepared and duly signed and sealed by a professional engineer or land surveyor.
