As used in this chapter, the following terms
shall have the meanings indicated:
DEALER
Any person, partnership or corporation who, through any means,
buys or sells gold, silver, precious metals or jewelry and includes
anyone advertising the purchase or sale of any of the aforementioned
items. "Dealer" shall not include anyone engaged in the casual purchase
or sale of any personally owned jewelry nor include such purchases
or sales which are not related to the conduct of a business.
MINOR
Any person under the age of 18 years.
Each dealer, before conducting business within the jurisdiction of the Borough of North Haledon, shall first register with the Chief of Police, who shall investigate the applicant, and shall obtain a license from the Borough Clerk by paying a fee as provided in Chapter
275, Fees. Said fee shall be waived for businesses established and conducting business in the Borough of North Haledon prior to passage of this chapter. A license issued under the provisions of this chapter shall not be transferable and shall terminate on December 31 of the year in which said license is issued. For any license issued prior to the effective date hereof, said license shall expire on December 31 of the following calendar year.
Each dealer shall obtain and maintain on forms
prescribed by the Borough Police Department the name, residence and
business address, occupation, date of birth, driver's license number
and state of issuance for the person from whom items were purchased,
received or sold and a description of all items purchased, received
or sold. These records shall be subject to the inspection of any authorized
police officer of the Borough of North Haledon. The record of the
transaction shall be signed by the seller and/or the person from whom
the property is obtained. Each dealer doing business in the Borough
of North Haledon shall deliver to the Chief of Police certified true
copies of the forms prescribed herein within 48 hours of the completion
of the transaction.
No dealer shall sell, melt, change the form
of or dispose of any articles purchased or received within 45 days
from the date of acquisition without prior notification to the Chief
of Police, and all such items shall remain on the premises where the
acquisition was made for at least 45 days.
Each dealer must require identification of the
person with whom he/she is transacting business, and no transaction
may be made with any minor, as hereinabove defined.
Any person as defined above who violates any provisions of this chapter shall, upon conviction thereof, be punishable as provided in Chapter
1, General Provisions, Article
II, General Penalty. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
