As used in this chapter, the following terms shall have the
meanings indicated:
PERSON
Includes a corporation, a joint-stock association and a partnership,
as well as an individual, as the case may be.
No person shall kindle or maintain an outdoor fire of any kind
or for any purpose whatever or authorize any such fire to be kindled
or maintained on or in any public place or highway or on any private
land, unless a written permit therefor shall have been previously
obtained from the office of the Mayor.
The provisions of this chapter shall not apply where a fire
is kindled or maintained in a stove, food grill, fireplace or incinerator
located not less than 20 feet from any building or structure. The
provisions of this chapter shall also not apply to welding, cutting
or painting operations.
No permit shall be issued whenever local circumstances, atmospheric
conditions or the location or nature of the fire shall create any
hazard in the judgment of the Mayor of the Village of Belle Terre
or the Chief of the Port Jefferson Volunteer Fire Department. The
permit is not conditioned upon payment of a fee. Any such permit shall
be void and of no force and effect if, at the time the permitted fire
is kindled or maintained, the wind velocity is in excess of 10 miles
per hour.
The Mayor of the Village of Belle Terre, any Trustee of said
village or any representative designated by them may prohibit any
fire at any time, whether or not a permit has been issued therefor,
whenever such fire is hazardous, in his judgment, due to local circumstances,
atmospheric conditions, the location and nature of the fire or otherwise.
