A. 
A special use permit for which conformance to conditional additional standards is required by this chapter shall be deemed to be permitted in the A Residence District, subject to the satisfaction of the requirements and standards set forth herein, as well as all other requirements of this chapter and those set forth in any chapter of the Village Code pertaining to such special use. All such uses are declared to possess characteristics of such unique and special forms that each use shall be considered as an individual case.
B. 
Special use permits for special uses as authorized by the Village Code shall issue from the Board of Trustees of the Village of Belle Terre. Special use permits shall issue in the form of a resolution of the Board of Trustees, stating findings and conditions.
C. 
Where a special use permit is required, no building permit and/or certificate of use or occupancy shall be issued by the Building Inspector until a special use permit has been approved and issued by the Board of Trustees.
D. 
The Board of Trustees may condition the permit by requiring that the applicant actually complete construction and begin the specially permitted use in compliance with the conditions imposed by the Board of Trustees within a time period of from one to three years. If the Board of Trustees fails to specify a period to complete construction and begin the specially permitted use, the time period to complete construction and begin the specially permitted use shall be one year.
E. 
The duration of a specially permitted use may be limited to a specified time period as set forth in the special permit resolution of the Town Board. If the Town Board is silent as to the duration of the specially permitted use, then said use shall be in perpetuity.
F. 
A specially permitted use, which has been discontinued for a period of one year or more, shall be deemed abandoned.

An application for a special use permit shall be submitted, in writing, to the Clerk Treasurer of the Village of Belle Terre. Such application shall contain any and all pertinent information that may be necessary to determine if the proposed special use meets the requirements of this chapter, as well as any other chapter specifically related to the proposed special use.
The fee for a special use permit shall be as set forth from time to time by resolution of the Board of Trustees.[1]

No special use permits shall be issued for a property where there exists a violation of any ordinance of the Village of Belle Terre. An applicant for a special use permit shall permit an inspection of the entire premises by the Village Building Inspector for the purpose of making such determination.
The Board of Trustees of the Village of Belle Terre shall have the authority and power to approve or disapprove a request for a special use permit.
