The Town Clerk of the Town of Mendon may issue a permit for the conducting
of games of chance in the corporate limits of the Village of Honeoye Falls,
as authorized by the Constitution of the State of New York and by § 187
of the General Municipal Law. Such permit shall be issued only in accordance
with state law and subject to the same conditions or limitations imposed on
the conduct of games of chance in the unincorporated area of the town.
This chapter shall remain in effect until superseded or repealed, as
provided in state law, and the Town Clerk shall have the authority granted
by this chapter only so long as the Clerk has authority to issue permits in
the unincorporated area of the Town of Mendon.
The enforcement officer of this chapter shall be the Chief Law Enforcement
Officer of the County of Monroe.
This chapter shall take effect thirty (30) days after its adoption unless,
within thirty (30) days after its adoption, there shall be filed with the
Village Clerk a petition signed and authenticated by qualified electors of
the Village of Honeoye Falls registered to vote in the last preceding general
election in number equal to at least twenty per centum (20%) of the total
number of votes cast for the Governor in the last gubernatorial election,
which petition protests this chapter and requests that it be submitted to
the electors of the village for their approval, in which case this chapter
shall take effect when approved by the affirmative vote of a majority of the
qualified electors voting on this chapter.
