No person shall play baseball, football or basketball
or any other open or field sport upon the streets or public grounds
within said Village at any time, or engage therein in any act, amusement
or practice endangering property or persons, except in areas designated
by any municipality or school authority as playing fields.
No person shall skate, slide or coast upon,
into or over or across any of the streets or sidewalks in said Village,
except such streets as are designated by the Board of Trustees.
All parades, processions, exhibitions and the
playing of bands or the use of sound trucks, upon the streets or public
grounds in said Village, are hereby prohibited, unless a permit or
license therefor in writing be granted by authority of the Board of
Trustees.
No person shall drive any animal on any of the
sidewalks in said Village, except horses used for plowing sidewalks
during the winter months.
No person shall mar, injure or deface any shade
tree in any street or public place in said Village, except where necessary
for public safety.
The owner or occupant of any lot adjoining any
of the streets or public places of said Village, shall keep the trees
adjoining the sidewalk in front of said premises trimmed up to at
least 10 feet above the sidewalk. And any person neglecting or refusing
to trim such trees within 24 hours after written notice requiring
such trimming has been served upon said owner or occupant, it shall
be the duty of the Board of Trustees, or other such official designated
by them, to cause such trees to be trimmed and the expense thereof
shall be assessed against the adjoining land, which shall be paid
by such owner in addition to the penalty hereinafter prescribed.
No person shall cause, allow or permit any horses,
cattle, sheep, swine, fowls or other animals to run at large in said
Village.
No person shall pile up before any door or on
any sidewalk or street in said Village any boxes, casks, barrels,
cases, rubbish or other materials or any merchandise; nor shall be
place, allow or permit any garbage or rubbish to be placed or remain
on any sidewalk or street, between the hours of 9:00 a.m. and 11:00
p.m., except on days designated by the Village Manager, for garbage
or rubbish pickup. No owner or occupant of any lands in said Village
shall allow any obstruction to the free and proper use by the public
of the sidewalks adjacent thereto, to be or to remain thereon.
No person shall place or leave any papers, dirt,
ashes or litter of any description, or any refuse matter whatever,
upon any of the streets or sidewalks in said Village, nor throw or
cause to be thrown or put upon the streets or sidewalks in said Village
any ashes, litter, sweepings, papers or other rubbish or material
whatsoever.
No person shall place or deposit any lumber
or other building materials on any street or sidewalks in said Village,
except as hereinafter provided. The Board of Trustees may grant, in
writing, on such conditions as it may subscribe, to any person to
place and keep any building material in any of the public streets
in said Village for the purpose of building or repairs, but such permit
shall not authorize the obstruction of more than 1/2 of the sidewalk
and 1/2 of the street adjacent to the lot on which the erection of
a building or repairs are being made, and the person receiving such
permit shall properly guard the public from all damages or injuries
resulting therefrom by the erection of proper barriers and the maintenance
of lights at night.
No person shall break or disturb any pavement
on any of the streets of said Village without first obtaining a permit
therefor from the Village Manager, and any person breaking or disturbing
such pavement shall be liable for all costs of replacement and damages
sustained thereby in addition to the penalty hereinafter prescribed.
No person shall, without the consent of the
Board of Trustees in writing, alter the grade of any sidewalk, and
all sidewalks hereafter constructed in said Village shall be built
on grades established by the Village Engineer or Manager, and shall
be constructed under his supervision.
No person shall erect, construct, place, or
cause to be erected, constructed or placed, any building or structure
extending or projecting into or over any street in said Village. Any
person violating any of the provisions of this section shall be liable
to the penalty hereinafter prescribed and, in addition thereto, the
further penalty of $25 for every 24 hours that the same shall be allowed
to remain after notice to the owner or occupant of said premises requiring
such removal; provided, however, that such penalty shall not be incurred
by reason of any swinging awnings attached to such building for the
purpose of shade, and which awning shall not project into the street
to a greater distance than is occupied by the sidewalk and shall not
be less than seven feet in the clear above the sidewalk.
No person shall wash, clean or spray any vehicle,
wagon, truck or other vehicle within or on any of the public streets
of said Village.
Any person violating any of the provisions of
this article shall be liable to a penalty of $25 for each offense.
In addition to the penalty herein prescribed, a violation of any of
the provisions of this article shall constitute disorderly conduct
and the person violating the same shall be a disorderly person.

This article shall hereafter be entitled "Street
and Sidewalk Opening Permits."
A. A street or sidewalk opening permit shall be required
of any person or persons, including individuals, partnerships, corporations
or unincorporated associations, intending to dog or ditch into or
across any Village-accepted street, sidewalk or right-of-way.
B. Street and sidewalk opening permits may be obtained at the Village Offices by providing the Village Clerk with a certificate of public liability insurance naming the Village as an insured party; completing an application for a street or sidewalk opening permit; returning a fully executed acknowledgment as is more particularly described in §
243-19A; and paying the fee for such permit as established by a resolution of the Village Board of Trustees.
The procedure for ditching a street, sidewalk
or right-of-way shall be as follows:
A. Care shall be taken and proper tools used so that
the pavement surrounding the area being excavated is not disturbed.
B. Unless the Village Highway Superintendent or the Village
Water and Sewer Superintendent or one of their agents advises otherwise,
all earth removed from the ditch must be drawn away by the person
obtaining the permit.
C. The person obtaining the permit is responsible for
closing such ditch by using dirt or sand. Such person or his agent,
servant or employee shall compact the dirt or sand with either heavy
equipment or compacting equipment until the ditch is full to the pavement.
A. It is the responsibility of the person obtaining the
permit to contact the Public Works Superintendent and call Dig Safe
NY two full working days in advance, excluding weekends and holidays.

B. There shall be no excavation on a Saturday or Sunday
except under an emergency as determined by the Village Manager or
the Superintendents of the Highway or Water and Sewer Departments.
C. It is the responsibility of the person obtaining the
permit and his contractors, agents, servants and employees to at all
times place a barricade around the ditch, and such barricade shall
consist of sawhorses, or barrels. Such excavated area shall be adequately
illuminated with flares or battery operated flashing safety lights.
D. The person obtaining such street or sidewalk opening
permit is liable for any property or personal injury resulting from
the opening or closing of such ditch.
A. The person obtaining the permit shall pay a fee established
by resolution of the Village Board at the time of obtaining the permit,
which fee shall take into consideration the anticipated expense of
the Village for patching such street or sidewalk. Such fee may be
changed by a resolution of the Village Board of Trustees.
B. Such fee may be added to the Village taxes of such property if not timely paid in advance with Subsection
A.
Any person found in violation of any provision
of this article shall be subject to a fine not to exceed $50 per day.
Each day such violation is committed or permitted to continue shall
constitute a separate offense and shall be punishable as such.
This article specifically repeals former § 57-11
of the 1965 Code of the Village of Saranac Lake and any other local
laws or ordinances that directly conflict with this article.
