This article shall be known as the "Dog Curbing
Ordinance."
The purpose of this article is to protect the
health, safety and welfare of all those frequenting the Township of
Tinicum. Further, it is the purpose of this article to prevent the
needless health hazards and nuisances caused by dog feces upon public
and private property located within the Township of Tinicum.
No person, agency or institution owning, harboring,
keeping or in charge of any dog or dogs shall cause, suffer or allow
such dog or dogs to soil, defile, defecate or commit any nuisance
upon any public or private property whatsoever, except with the express
authority or permission of the owner of said property. The restriction
in this section shall not apply to the portion of the street lying
between the curblines or the curbline and the sidewalk which may be
used to curb such dogs under the following conditions:
A. Any person, agency or institution which owns a dog
within the Township shall not permit such dog to be unattended within
the Township and shall require that said dog be restrained by a leash
or other appropriate device which, for the purpose of this article,
shall be "curbing."
B. Any person who so curbs a dog shall immediately remove
all feces deposited by such dog by any sanitary method approved by
the Health Officer of the Township of Tinicum, and same shall be deposited
in the owner's garbage or in some other sanitary manner approved by
the Health Officer of the Township of Tinicum. The deposit shall be
properly wrapped, packaged or protected as to prevent unsightly disposal
or smell or interference with the health and welfare of the community
of the Township.
Any person or persons convicted of violating
this article shall be subject to a fine of not more than $600, plus
costs of prosecution, and, in default of payment of such fine and
costs, imprisonment in the county jail for a period not exceeding
30 days.
