As used in this chapter, the following terms shall have the meanings indicated:
MINIBIKE
Every motor vehicle having a saddle for the use of operators and/or riders and designed to travel on not more than three wheels in contact with the ground, and shall include bicycles with gas- or diesel-operated motors attached, scooters with gas- or diesel-operated motors attached, and other similar vehicles; except, however, any such vehicle as may be included within the term "tractor" as defined in the Motor Vehicle Code of the Commonwealth of Pennsylvania.
No person who resides in the Township of Tinicum shall operate, propel or ride, as either operator or passenger, any minibike on any street, public alley or any public path in the Township of Tinicum unless such minibike shall have first been registered as provided herein.
No person, not a resident of the Township of Tinicum, shall operate, propel or ride, as either operator or passenger, any minibike, ordinarily kept within the limits of the Township of Tinicum, on any street, public alley or any public path in the Township of Tinicum, unless such minibike shall have been registered as provided herein.
Every owner of a minibike, or the parent or guardian of a minor owner thereof, shall on or before the first day of April in each and every year register such vehicle by providing to the Police Department of the Township of Tinicum the name and address of the owner and the manufacturer's serial number of such vehicle.
The Chief of Police of Tinicum Township shall maintain a current listing of those minibikes registered in the Township of Tinicum and shall issue a receipt to the owner of each vehicle so registered. There shall be no charge for the registration.
If any minibike shall be found in any street, public alley or any public path in the Township of Tinicum that has not been registered as set forth herein, it shall be prima facie evidence that such minibike is being operated without proper registration.
It shall be unlawful for any person to operate a minibike upon any street, public alley or any public path in the Township of Tinicum in violation of any traffic ordinance of the Township or in violation of the Motor Vehicle Code of the Commonwealth of Pennsylvania.
It shall be unlawful for any person to operate a minibike upon any street, public alley or any public path in the Township of Tinicum after the hours of 7:00 p.m. and prior to 7:00 a.m. without a head lamp and a rear lamp on said minibike.
It shall be unlawful for any person to ride on a minibike upon any street, public alley or any public path in the Township of Tinicum as a passenger unless said minibike is equipped with a passenger's seat and back rest.
It shall be unlawful for any person to operate a minibike upon any street, public alley or any public path in the Township of Tinicum without reflectors prominently displayed on the rear fender.
It shall be unlawful for any person to operate or ride as a passenger on a minibike upon any street, public alley or public path in the Township of Tinicum without wearing a motorcycle helmet secured to the head by means of a chin strap.
It shall be unlawful for any person at any time to operate a minibike upon any sidewalk in the Township of Tinicum.
Any person who shall violate any of the provisions of this chapter shall, upon summary conviction thereof, be sentenced to pay a fine of not more than $600, plus costs of prosecution, and, in default of payment of such fine and costs, to imprisonment in the county jail for a period not exceeding 30 days.
