A.
Departments of service enumerated. The administrative
service of the city shall be divided into the following departments
and heads thereof:

officials existing at the time of passage of the charter.

B.
General duties of department and division heads. Each
department and division head shall perform all duties required of
his or her office by state law, the City Charter, this code and rules
and regulations of the city, and such other duties not in conflict
therewith as may be required by the Mayor.
C.
Department heads responsible to Mayor.
(1)
Each department head, except the Comptroller, shall
be appointed by the Mayor and shall be immediately responsible to
the Mayor for the effective administration of his or her respective
department and all activities assigned thereto. Whenever practicable,
the department head shall be hired on a contractual basis rather than
as a Civil Service position.
(2)
The Comptroller shall be hired by the Common Council
and shall report to the Mayor and to the Common Council as from time
to time required for the effective financial administration of the
city.
D.
Specific responsibilities of department heads.
(1)
Practices and regulations. Each department head shall
keep informed as to the latest practices in his or her particular
field and shall inaugurate, with the approval of the Mayor, such new
practices and regulations as appear to be of benefit to the administrative
service of the city and to the public.
(2)
Reports. Each department head shall submit reports
of the activities of his or her department to the Mayor as prescribed
by the Mayor and the City Charter.
(3)
Records. Each department head shall establish and
maintain a system of filing and indexing records and reports in sufficient
detail to furnish all information necessary for proper control of
departmental activities and to form a basis for the periodic reports
and inventories to the Mayor.
(4)
Maintenance of city property, equipment. Each department
head shall be responsible for the proper maintenance of all city property
and equipment used in his or her department.
(5)
Departments to cooperate. Departments in the administrative
service of the city shall cooperate with each other and shall, upon
the direction of the Mayor, furnish to any other department such service,
labor and materials as may be requisitioned by the head of such department,
and as its own facilities permit, through the same procedure and subject
to the same audit and control as other expenditures are incurred.
E.
Compilation of department rules and regulations; review.
Each department, under the direction of the department head, shall
compile a set of rules and regulations with respect to its internal
operations which shall not be inconsistent with the City Charter or
this chapter. Before promulgating such rules and regulations, the
department head shall submit them to the Mayor and Corporation Counsel
for review.
F.
Filing of departmental reports with City Clerk. Duplicate
copies of all departmental reports which are required by this chapter
shall be filed with the office of the City Clerk according to the
department and the nature of the report and such reports shall be
matters of public record and open to review by interested citizens.
G.
Financial procedures.
(1)
Daily deposits required. All units in the administrative
service of the city shall make a daily deposit with the City Comptroller
of any moneys received directly from the public.
(2)
Paying out money. All units in the administrative
service of the city shall pay out moneys belonging to the city only
in the manner prescribed herein and in the City Charter.
Duties of the city departments, offices, agencies
or boards identified and defined in the Charter shall remain the same
unless specifically modified or amended herein. Notwithstanding the
above, any reference to or use of the term "Board of Public Works,"
"Fire Board" or "Board of Parks and Recreation" in the Kingston City
Charter shall be amended to delete said reference and term, and to
replace the same reference and term with the word, "Mayor." Any reference
to the powers, duties, and responsibilities of the "Board of Public
Works," "Fire Board," or "Board of Parks and Recreation" in the City
Charter shall be amended to be the powers, duties, and responsibilities
of the Mayor.
A.
The Department of Public Works shall be headed by
the Superintendent of Public Works and shall have the care and control
of the streets, sewers, municipal buildings and property of the city.
A.
The Fire Department shall, as to its rules and regulations,
remain as now constituted until the same shall be changed by administrative
action of the Mayor.
B.
In addition, the Fire Department shall be responsible
for the administration and enforcement of Subchapter A, B, C, E and
F of the New York State Uniform Fire Prevention and Building Code
in the City of Kingston, New York and shall establish powers, duties
and responsibility in connection therewith.
C.
Any reference or use of the term "Building Safety
Division of the Fire Department" in the Kingston City Code shall be
amended to delete said reference and term and to replace the same
with the term "Building Department."

D.
Any reference or use of the term "Fire Officer," in
the Kingston City Code shall be amended to delete said reference and
term and to replace the same with the term "Building Safety Officer."

A.
The Department of Parks and Recreation shall, as to
its membership, component parts, rules and regulations remain as now
constituted until the same shall be changed by administrative action
of the Mayor.
B.
The Mayor shall have the powers and duties in the
administration of the Department of Parks and Recreation as were previously
designated as the powers and duties of the Board of Parks and Recreation
Commissioners.
A.
The Police Department shall, as to its membership,
component parts, rules and regulations remain as now constituted until
the same shall be changed by administrative action of the Mayor and
Board of Police Commissioners.
B.
A Commission will be established for the Police Department
which will have the authority to set departmental practices in recruiting,
hiring, promoting and disciplining, all in accordance with statutory
authority, and to make recommendations to the Mayor and the Chief
of Police regarding practices, procedures, policy and planning. The
Commission shall consist of five members who will serve four year
terms which shall expire on May 31st. The Mayor shall be chairperson
of the board and will appoint the other four members. The Chief of
Police is directly responsible to the Mayor and the Board of Commissioners.
The Common Council may, by resolution, delegate to the Commission
the responsibility of review of all vouchers submitted for Police
Department expenses and recommendation to the Common Council regarding
approval for payment.

A.
An advisory board shall be established for the Department
of Public Works, Fire Department and Department of Parks and Recreation.
B.
The advisory boards for each of the departments referred
to above shall make recommendations to the Mayor regarding practices,
procedures, policy and planning. The Common Council may, by resolution,
delegate to any individual advisory board, or to all advisory boards,
herein, the responsibility of review of all vouchers submitted for
department expenses and recommendation to the Common Council regarding
approval for payment.

C.
The Advisory Board for the Department of Public Works
shall also review any grievance or complaint regarding a sewer use
charge or other sewer use issue and shall make recommendations to
the Common Council regarding any adjustment to a sewer use charge
or other sewer use issues.
D.
The Advisory Boards for the Department of Public Works
and the Fire Department shall consist of five members who shall be
residents of the City of Kingston and shall serve without compensation
for a two year term which shall expire on December 31.
E.
The Advisory Board for the Department of Parks and
Recreation shall consist of seven members who shall be residents of
the City of Kingston and shall serve without compensation for a two
year term which shall expire on December 31.
F.
The Mayor will be the Chairperson of the Advisory
Boards for the Department of Public Works and Fire Department and
will appoint the other four members. The Mayor will not serve as the
Chairperson of the Advisory Board for the Department of Parks and
Recreation but will appoint the seven members of this Board.
All other resolutions, ordinances and local
laws of the City of Kingston, New York, or parts thereof which are
inconsistent herewith are repealed, except such resolution, ordinance
or local law or parts thereof which are predicated upon laws, statutes,
rules and regulations which themselves are superior or binding upon
the City of Kingston New York.
This Administrative Code shall take effect January
1, 1996.
