It is the purpose of this article to comply with the New Jersey Statewide Mandatory Source Separation and Recycling Act, N.J.S.A. 13:1E-99.11 et seq.

A. 
The position of Recycling Coordinator is hereby created and established within the Borough of Woodcliff Lake.
B. 
The Recycling Coordinator shall be appointed by the governing body for a term of one year, expiring December 31 of each year.
C. 
The Recycling Coordinator, subject to the approval by the governing body, shall establish and promulgate reasonable rules and regulations as to the manner, days and times for the collection, storage, transportation, sale and/or marketing of said recyclable materials in order to encourage the preservation of material resources while minimizing the cost of the recycling program to the Borough of Woodcliff Lake.
D. 
The Recycling Coordinator shall annually submit a recycling tonnage report to the New Jersey Office of Recycling and any other such reports required by the Bergen County Utilities Authority.

A. 
Residents are required to keep recyclables out of the garbage. From time to time the way recyclables are collected may change, so residents must follow what is posted on the Borough website or mailed out annually on the sanitation schedule. Residents are encouraged to check the website from time to time for updates and changes. Collection days will be posted on the website with information on what items are being collected and how to set those at the curb.
B. 
General guidance for what recyclables are: glass beverage containers, aluminum cans, tin cans, plastic bottles and containers Nos. 1 through 7, mixed papers, newspapers, corrugated cardboards, chipboards.
C. 
Other recyclables are: textiles, used oils, books, ferrous scrap, white goods, leaves, flags, brush, electronics, grass, construction and demolition debris (concrete, brick, tree parts, nonferrous/ferrous metal, where practical). Not all recyclable materials are collected at the curb. Leaves are only collected during leaf season each year. Definitions of all recyclables will be posted on the website and are subject to change.
D. 
Recyclables must be set out by 6:00 a.m. on the day of collection. Set-out times are no earlier than 6:00 p.m. the night before collections, and containers must be removed from the curb no later than 8:00 p.m. the day of collection. Bottles and containers must be cleaned out and rinsed out before setting out for collection. The annual collection schedule, along with guidance for what materials are being collected and how to set those materials at the curb, will be posted on the website and in newsletters and sent through other forms of Borough communication.
E. 
If the collector left the material because it was set out incorrectly or mixed with improper materials, the resident is required to remove the materials from the curb by 8:00 p.m. on the day of the collection and correct the problem and set out on the next scheduled collection date.
F. 
The Ecology Center hours may change at times due to unforeseen circumstances, and all changes will be posted on the website. The Ecology Center is normally open on Wednesdays, Saturdays and Sundays. Check the website for hours. Closed on holidays and may be closed during inclement weather. See the website for details on what can be dropped off. Recycling may be separated or commingled at the discretion of the Recycling Coordinator.

Commercial users must recycle corrugated cardboard, high-grade office paper, glass beverage containers, ferrous scrap, white goods, aluminum cans, mixed paper, and construction and demolition debris (concrete, brick, tree parts, nonferrous/ferrous metal, asphalt, corrugated cardboard, where practical). Institutional users must recycle corrugated cardboard, high-grade office paper, glass beverage containers, ferrous scrap, white goods, aluminum cans, mixed paper, and construction and demolition debris (concrete, brick, tree parts, nonferrous/ferrous metal, asphalt, corrugated cardboard, where practical). Nothing in this article shall be deemed to prohibit any owner, lessee or occupant of residential property of disposing of recyclable materials privately though a sale or gift, provided that in no event shall such recyclable materials be left at the curb for any private pickup and further provided that in no event shall any such recyclable materials be disposed of as part of the solid waste pickup by the Borough of Woodcliff Lake in accordance with the normal pickup by the Borough of Woodcliff Lake.
It shall be a violation of this article for any person unauthorized to collect or pick up or cause to be collected or picked up any such recyclable materials for any purpose whatsoever once the same has been placed at the curb or Ecology Facility. Any and each such collection in violation hereof from one or more premises shall constitute a separate and distinct offense punishable as hereinafter provided.

The Recycling Coordinator shall notify all persons owning, leasing or occupying the property within the Borough of Woodcliff Lake of the Borough's recycling opportunities and the source separation requirements of this article. This notice shall be done by mailing to all postal patrons within the Borough and by posting a notice in public places where public notices are customarily posted by the Borough.[1]

B.

Said notification shall be done in a mailing to all postal patrons within the Borough and by posting a notice in public places where public notices are customarily posted by the Borough.[2]

The enforcement of the provisions of this article shall be the responsibility of the Recycling Coordinator, Health Officer, Sanitarian, Zoning Officer and Department of Public Works. The responsibility of monitoring the program for the adequacy of the collection and all other terms of the established rules and regulations is that of the Recycling Coordinator.
A. 
Any person, firm or corporation who violates or neglects to comply with any provisions of this article or any rule or regulation promulgated pursuant thereto shall be punishable, upon conviction thereof, by a fine and/or penalty as provided below:
(1) 
First offense: a fine of $25.
(2) 
Second offense: a fine of $50.
(3) 
Third offense: a fine of $100, or, as an alternate penalty, a convicted person may be ordered to perform community service in the recycling program for a period not to exceed 25 man-hours of labor.
(4) 
Fourth and each subsequent offense: a fine of $500, or, as an alternate penalty, a convicted person may be ordered to perform community service in the recycling program not to exceed 90 days (the equivalent of 720 man-hours of labor) and/or up to 90 days in jail. Each day such violation or neglect is committed or permitted to continue shall constitute a separate offense and be punishable as such.
B. 
Fines levied and recovered for noncompliance with any and all provisions of this article shall be transmitted monthly by the Court Administrator to the Borough Treasurer and placed in the current fund and recorded as a dedication by rider to be utilized for the purpose of the Borough's recycling program, to include but not limited to education, awareness and improvement in services, in accordance with the provisions of N.J.S.A. 40A:4-39.
