[HISTORY: Adopted by the Board of Trustees of the village of Hewlett Bay Park 1-5-1994 by L.L. No. 1-1994. Amendments noted where applicable.]
The Board of Trustees of the Village of Hewlett Bay Park hereby finds and determines that the best interests of the village would be served by the establishment of a Village Justice Court, pursuant to Village Law § 3-301, having the powers and duties prescribed in the Uniform Justice Court Act, and that such interests would be furthered by the transfer to such Village Justice Court of all proceedings within its jurisdiction and pending in the District Court of Nassau County on the effective date of this chapter, to the extent permitted by law.
A. 
There are hereby established in the Village of Hewlett Bay Park the offices of Village Justice and Acting Village Justice.
B. 
The Village Justice and the Acting Village Justice shall serve without compensation.
The Village Justice Court of the Village of Hewlett Bay Park shall have such jurisdiction as is permitted by the Uniform Justice Court Act of the State of New York and other laws of the State of New York and of the County of Nassau.
No action pending at the effective date of this chapter shall abate by virtue of the adoption of this chapter. All such actions shall instead continue in the court in which they are then pending, unless transferred to the Village Justice Court as may be provided by law.
A. 
The Village Justice Court is hereby authorized to establish a Traffic Violations Bureau to assist the Court in the disposition of offenses in relation to traffic violations.
B. 
Such Traffic Violations Bureau, when established, is authorized to dispose of violations of traffic laws, ordinances, rules and regulations, including parking violations, when such offenses do not constitute the traffic infraction known as "speeding" or a misdemeanor or felony, by permitting a person charged with an offense, within the limitations of General Municipal Law Article 14-B, to answer, at any time between the receipt of the summons or appearance ticket and a time 48 hours prior to the return date thereof, at such Traffic Violations Bureau, either in person or by written general or special power of attorney, by paying a prescribed fine and, in writing, waiving a hearing in Court, pleading guilty to the charge and authorizing the person in charge of the Bureau to make such a plea and pay such fine in Court.
C. 
Such Traffic Violations Bureau shall have the powers and shall be subject to the limitations set forth in Article 14-B of the General Municipal Law and shall be subject to such additional limitations as the Court establishing it may designate from time to time.
D. 
The procedure before such Traffic Violations Bureau shall be that provided in Article 14-B of the General Municipal Law.
