The Director of the Department of Law shall
be the Township Attorney.
The Township Attorney shall be responsible for
the performance of general legal services on behalf of the Township
which shall include but not be limited to the following:
A. The preparation of such ordinances and resolutions
as may be required by the Township Council.
B. The review of all contracts, performance guarantees
and other documents as may be required by the Mayor.
C. The initiation and defense of litigation which may
affect the interest of the Township.
D. The rendering of such legal consultation as may be
from time to time required by the Mayor, the Township Council, or
the various departments.
E. The attendance at meetings of the Township Council.

A. The office
of Municipal Prosecutor is hereby established within the Department
of Law.
B. The Municipal
Prosecutor shall be appointed by the Mayor for a term of one year
and shall serve until the appointment and qualification of his successor.
C. The Municipal
Prosecutor shall be an attorney at law for the State of New Jersey.
D. Duties and
responsibilities.
(1) It shall
be the duty of the Municipal Prosecutor to conduct prosecutions for
defense cognizable in the Municipal Court.
(2) The
Municipal Prosecutor shall have those duties and responsibilities
as are imposed by law.

A. There is
hereby established the office of Township Public Defender within the
Department of Law.
B. The Township
Public Defender shall be an attorney at law for the State of New Jersey.
C. The Public
Defender shall be appointed by the Mayor and shall serve for a term
of one year from the date of his appointment or until the appointment
and qualification of his successor.
D. The Public
Defender shall represent only those defendants in the Municipal Court
who have been established as indigent in accordance with standards
established by the Judge of the Municipal Court. In addition, the
Public Defender shall undertake such representation only after the
defendant seeking representation executes an agreement providing for
the reimbursement of the Township for costs incurred in compensating
the Public Defender for such representation. A person who is applying
for representation by the Municipal Public Defender shall follow the
procedures in the Municipal Court for application for the services
of the public defender.

There is hereby established the position of
Attorney for the Division of Utilities within the Department of Law.
The Attorney to the Division of Utilities shall be appointed by the
Mayor with the advice and consent of Council, and shall be responsible
for providing legal services and consultation as may be required by
the Division of Utilities on behalf of the Township.

A. Position established. There is established the position
of Conflict Public Defender.
B. Appointment. A Conflict Public Defender shall be appointed
when the Township Public Defender is unable to undertake representation
for indigent defendants.
C. Selected on case-by-case basis. The Conflict Public
Defender shall be selected by the Mayor or Business Administrator
on a case-by-case basis.
D. Compensation. The compensation for the Conflict Public
Defender shall be established by ordinance of the Township Council.
There is hereby established the position of Municipal Conflict
Prosecutor who shall be an attorney at law for the State of New Jersey.
The Municipal Conflict Prosecutor shall appear on behalf of the Township
when the Municipal Prosecutor is unable to attend a session or if
a conflict in representation exists. The fee to be paid to the Conflict
Prosecutor shall be established by ordinance of the Township Council.
