Each applicant for a permit shall file an application with the
Director of Public Health and shall pay a filing fee in an amount
set by the Board of Health and approved by the Common Council. Such
fee shall not be refundable.
The application for a massage therapist permit shall be in writing,
signed, sworn to by the applicant, and shall contain the following:
A. The name and residence address of the applicant.
C. The applicant's height, weight, color of hair and eyes, and
a full set of applicant's fingerprints (fingerprints to be taken
by the Chief of Police or his/her designee).
D. Written evidence that the applicant is at least 18 years of age.
E. Business, occupation, or employment history of the applicant for
three years immediately preceding the date of application.
F. Whether such person has ever been convicted of any crime within the
last 10 years except minor traffic violations.
G. Two portrait photographs of the applicant at least two inches by
two inches.
H. A copy of the applicant's Connecticut massage therapist license
issued under Sections 20-206a through 20-206c of the Connecticut General
Statutes.
I. Authorization to conduct a criminal background check on the applicant.
J. Such other information as may be necessary in order for the Director
of Health to make any determination required by this chapter.
The Director of Health shall issue a permit within 45 days after
such application has been filed upon finding:
A. That the applicant has complied with the requirements of Sections
20-206a through 20-206c of the Connecticut General Statutes and this
chapter.
B. That the applicant has not been convicted of a felony, an offense
involving the unauthorized practice of the healing arts, sexual misconduct
with minors, obscenity, keeping or residing in a house of ill-fame,
solicitation of a lewd or unlawful act, prostitution or pandering.
C. The applicant has not had a massage establishment or massage therapist
permit suspended or revoked in this state or any other state.
The Director of Health shall notify the applicant in writing
of his other decision to refuse to issue the permit and the reasons
therefor.
Any massage therapist permit may be revoked or suspended by
the Director of Health if the permittee is involved in any violations
including, but not limited to, any of the following:
A. Is convicted of any offense involving moral turpitude, obscenity,
sexual misconduct, keeping or residing in a house of ill-fame, solicitation
or a lewd or unlawful act, prostitution or pandering; the record of
conviction being conclusive evidence thereof;
B. Furnishes or makes any misleading or false statement or report in
relation to this chapter;
C. Refuses to submit to the Director of Health any reports or refuses
to make available any records required by the Director of Health in
investigating the permittee for purposes of this chapter;
D. Willfully or deliberately violates any of the provisions of Sections
20-206a to 20-206c of the Connecticut General Statutes, this chapter
or the rules and regulations established by the Director of Health
pursuant to this chapter.
