The owner or lessee of any swimming pool which is open to use
by members of the public upon payment of a fee, or to others as members
of a club or association having an agreement with said owner or lessee
for the use of the pool by its members, shall erect a sign notifying
the users whether or not a qualified lifeguard is stationed at such
pool.
Where a qualified lifeguard is not stationed at such pool, or
when a qualified lifeguard is stationed at such pool but is temporarily
absent from duty, said sign shall bear the notation "No Lifeguard."
Where a qualified lifeguard is stationed at such pool and is on duty,
said sign shall read "Lifeguard."
For the purposes of this article, the terms used herein are
defined as follows:
QUALIFIED LIFEGUARD
One who possesses a Senior Water Safety Certificate or Instructor's
Certificate under an accredited Red Cross lifesaving course or equivalent
course.
The lettering on said sign shall be in letters at least six
inches in height and of design and color so as to be clearly visible
from all parts of the pool and its surrounding walkways.
Any person who shall fail to erect and maintain such sign, or
fail to cause it to indicate the absence of a lifeguard where one
is stationed but not on duty, shall be fined $50 and shall be further
subject to civil action to enforce compliance with this article.
