A.
The
City of Albany, may, at the discretion of the Board of Aldermen, make
available a water supply to users beyond the City limits of the City
of Albany, Missouri.
B.
Said
water supply shall be for the use of those users or group of users
specifically approved by the Board of Aldermen and any additional
users hooking onto water lines constructed under the terms of this
Section must be approved by the Board of Aldermen.
C.
Those
approved for service by the Board of Aldermen, shall pay the cost
of all labor and materials required to provide service, including
required lines and meters within the City limits. City crews shall
install all water lines and meters within the City limits. Water lines
and facilities beyond the City limits shall be constructed by the
non-city user and shall be subject to the inspection and approval
of the City of Albany, Missouri.
D.
Any
water lines, meters and any construction within the City limits shall
become the property of the City of Albany and the City shall be responsible
for maintaining the same. Non-city users will maintain all water supply
facilities outside the City limits which carry water to their property.
E.
The
non-city user shall promptly repair any water leaks or defects in
the system outside the City limits. In the event prompt repairs are
not made, the City shall shut off the water supply to the non-city
user until all leaks or defects are repaired, or in the alternative,
the City may repair all leaks and defects and charge the cost of repairs
including both labor and materials to the non-city user.
F.
Should
approved non-city users allow unapproved non-city users to hook on
to water lines constructed under the terms of this Section, the City
shall shut off the water supply to said approved non-city users until
the unapproved user is either approved by the Board of Aldermen or
the unapproved hook-up is severed.
G.
Water
sold to approved non-city users outside the City limits shall be metered
at the City limits. The regular City water rates shall be charged
to each non-city user.

A.
Lead
Ban — General Policy.

Purpose. The purpose of this Section is:

Application This Section shall apply to all premises served by the
public drinking water system of the City of Albany, Missouri.
3.
Policy. This Section will be reasonably interpreted by the Water
Purveyor. It is the purveyor’s intent to ban the use of lead
based material in the construction or modification of the City’s
drinking water system or private plumbing connected to the City system.
The cooperation of all consumers is required to implement the lead
ban.
If, in the judgement of the Water Purveyor or his/her authorized
representative, lead based materials have been used in new construction
or modifications after January 1, 1989, due notice shall be given
to the consumer. The consumer shall immediately comply by having the
lead based materials removed from the plumbing system and replaced
with lead free materials. If the lead based materials are not removed
from the plumbing system, the water purveyor shall have the right
to discontinue water service to the premises.

WATER PURVEYOR
Definitions. The following definitions
shall apply in the interpretation and enforcement of this Section:
The owner or person in control of any premises supplied by
or in any manner connected to a public water system.
Any material containing lead in excess of the quantities
specified within the definition of "lead free" below.
Means:
When used with respect to solder and flux, refers to solders
and flux containing not more than 0.2 percent (0.2%) lead; and
When used with respect to pipes and pipe fittings, refers to
pipes and pipe fittings containing not more than 0.25 percent (0.25%)
lead.
Calculation – The weighted average lead content of a pipe,
pipe fitting, plumbing fitting, or fixture shall be calculated by
using the following formula: For each wetted component, the percentage
of lead in the component shall be multiplied by the ratio of the wetted
surface area of that component to the total wetted surface area of
the entire product to arrive at the weighted percentage of lead of
the component. The weighted percentage of lead of each wetted component
shall be added together, and the sum of these weighted percentages
shall constitute the weighted average lead content of the product.
The lead content of the material used to produce wetted components
shall be used to determine compliance with definition above. For lead
content of materials that are provided as a range, the maximum content
of the range shall be used.
Exemptions.
Pipes, pipe fittings, plumbing fittings, or fixtures, including
backflow preventers, that are used exclusively for non-potable services
such as manufacturing, industrial processing, irrigation, outdoor
watering, or any other uses where the water is not anticipated to
be used for human consumption.
Toilets, bidets, urinals, fill valves, flush-o-meter valves,
tub fillers, shower valves, service saddles, or water distribution
main gate valves that are two (2) inches in diameter or larger.
Any publicly or privately owned water system supplying water
to the general public which is satisfactory for drinking, culinary
and domestic purposes and meets the requirements of the Missouri Department
of Natural Resources.
The owner, operator, or individual in responsible charge
of a public water system.

The Board of Aldermen of the City of Albany, Missouri, acknowledges
that the City's membership and fee would be for a three (3) year period
and do hereby authorize the City Clerk to add a three dollar ($3.00)
charge (regional water fee) to one (1) month's water bill each of
the next three (3) calendar years with such month to be selected by
the City Clerk. Any obligation beyond the three (3) year period, membership
and fee shall require the approval of the Board of Aldermen.
