Unless approved as part of an alcoholic beverage and open container application and permit issued by the Chief of Police of Souderton Borough, no person shall have, possess, or transport liquor, wine, beer or other alcoholic beverages in, or upon any public sidewalk, street, parking lot or public park in the Borough of Souderton in open containers, and no persons shall drink or consume liquor, wine, beer or other alcoholic beverages in or upon any public sidewalk, street, parking lot, shopping center, public park, playground or other public place in the Borough of Souderton. The permit and application identified in this § 203-1 is limited to events open to the general public as approved by and in compliance with Borough Ordinances and shall include a fee as established by the Borough.
Any person who shall violate any of the provisions of this article shall, upon conviction thereof before any Magisterial District Judge, be sentenced to pay costs and a fine not exceeding $300 or to imprisonment in the county jail for a term not exceeding 30 days, or to both such fine and imprisonment.
