It shall be unlawful for any person or a group of persons, regardless
of age, in any public place, to cause discomfort or danger to any
other person or persons or users of the Borough streets, sidewalks,
alleys, parking lots, public parks and public and private places or
buildings by creating a breach of the peace, the obstruction of pedestrians
or vehicles, the disturbance of the comfort and convenience of any
person or the obstruction, harassment or interference of any person
lawfully in or upon any such street, sidewalk, alley, parking lot,
public park, public or private building or place of business. Violations
of this section shall be in addition to other conduct prohibited in
Chapter 55 of the Pennsylvania Crimes Code relating to disorderly
conduct, public drunkenness, and obstructing public highways and public
passages. For purpose of this article, "public place" shall mean a
place which the public or a substantial group has access; among the
places included are streets, sidewalks, alleys, parking lots, schools,
parks, apartment houses, places of business or amusement and any neighborhood
or other premises which is open to the public.
Nothing in this article shall prevent or prohibit the congregation
of two or more persons for lawful assembly, or for purposes otherwise
protected by the Constitutions of the United States or the Commonwealth
of Pennsylvania, so long as such conduct does not otherwise constitute
a violation of this article.
Whenever the presence of any person or group of persons is or
is likely to cause any of the violations set forth in this article,
any police officer shall order such persons to leave that place. Failure
or refusal to leave after being ordered to do so by a police officer
shall constitute a violation of this article.
Any person who shall violate any of the provisions of this article
shall, upon conviction thereof before a Magisterial District Judge,
be sentenced to pay costs and a fine not exceeding $1,000.
