This chapter shall be known as "Intergovernmental Cooperation Agreements for the Purchase, Sharing and/or Rental of Equipment and/or Services."
As used in this article, the following terms shall have the meanings indicated:
LOCAL GOVERNMENT
A county, city of the second class, second class A and third class, borough, incorporated town, township, school district or any other similar general purpose unit of the government created by the General Assembly after July 12, 1972.
The background of this article and the legislative intention of the City of Greensburg in enacting it are as follows:
A. 
The City of Greensburg is a Home Rule Charter municipality organized under the laws of the Commonwealth of Pennsylvania.
B. 
The Intergovernmental Cooperation Act, 53 Pa.C.S.A. § 2301 et seq., authorizes two or more local governments in the commonwealth to jointly cooperate in the exercise or in the performance of their respective governmental functions, powers or responsibilities, so long as both local governments adopt an ordinance so providing.
C. 
The City of Greensburg City Council, recognizing the benefits of sharing municipal resources and services, has determined that it is in the best interest of the City in certain instances to enter into intergovernmental cooperation agreements with other local governments for the purchase, sharing and/or rental of equipment.
The covenants, terms and conditions of the Intergovernmental Cooperation Agreement are hereby incorporated herein by reference.
A. 
Duration of the agreement. The term of the agreement shall commence upon the execution by both parties and shall expire on December 31, 2020, or at such time the City transfers, sells, or disposes of the truck, whichever first occurs. The agreement may be terminated by either party by providing 60 days' written notice.
B. 
Purpose and objectives of the agreement. The purpose of the agreement is to provide South Greensburg Borough use of the City's bucket truck through rental from time to time when needed and upon availability.
C. 
Manner and extent of financing the agreement. South Greensburg Borough agrees to pay to the City a rental fee for each hour, or portion of each hour, they possess the truck. Said fee is as agreed to and set forth in the terms of the agreement.
D. 
Organizational structure necessary to implement the agreement. The Mayor and President of City Council and the Secretary are hereby authorized and directed on behalf of the City of Greensburg to execute and deliver the agreement and to execute and deliver such additional instruments, and to take such further actions, as may be necessary or appropriate to carry for the agreement and the transactions to be effected under the agreement, including invoicing of such amounts as are due.
E. 
Manner in which real or personal property shall be acquired, managed, licensed or disposed of. User shall be given permission to use the bucket truck under the terms and conditions set forth in the intergovernmental rental agreement as approved by City Council on March 9, 2015, to be filed with the minutes of said meeting at the City Administration Office.
