The Board of Commissioners of Tinicum Township finds that the parking of motor vehicles upon the front lawns are unsightly and create a safety hazard that is detrimental to the general safety and welfare of the public.
As used in this article, the following terms shall have the following meanings indicated:
FRONT YARD
That portion of the lot extending from the front of the structure to the street line, excluding any driveway specifically intended for the parking of motor vehicles. In the case of a corner lot, the yards extending along any streets shall be considered front yards.
MOTOR VEHICLES
One or more automobiles, including, vans, SUVs, trucks and motorcycles.
PARKING
The standing of a motor vehicle on private property within the area designated as a front yard by any person or party who has direct control over such motor vehicle.
From and after the passage of this article, it shall be unlawful for any person owning or having control of a motor vehicle to stand or park such vehicle in the front yard of any property, or in any area in front of a residential or commercial property, within the Township of Tinicum, except upon driveways or improved parking areas.
The provisions of this article shall not apply to emergency or public service vehicles, or where the motor vehicle is parked on a temporary basis for delivery, loading or unloading, which shall not exceed a period of four hours per day.
Parking in the front yard may be authorized for special events or circumstances by permit issued at the discretion of the Tinicum Township Board of Commissioners.
Any person, firm or corporation who shall violate any provision of this article, upon conviction thereof, an action brought before a Magisterial District Judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Civil Procedure, shall be sentenced to pay a fine of not more than $25, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 10 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this article that is violated shall also constitute a separate offense.
