The present officers of the Woodlawn Cemetery Association having
petitioned and requested the Board of Aldermen to accept assignment
of the assets of said association; and it appearing to the Board of
Aldermen that it would be to the best interests of the citizens of
the City of Leadington if the said request were granted. The Board
of Aldermen hereby accepts assignment of all the assets of the Woodlawn
Cemetery Association, real and personal, thereby assuming and accepting
title thereto, with the responsibilities, powers, duties and obligations
running therewith.

The conveyance of the cemetery known as "Woodlawn Cemetery,"
as platted in the Recorder's Office of St. Francois County, Missouri,
excepting those lots previously conveyed, is hereby accepted by the
City of Leadington as a cemetery within the City and to be owned by
the City of Leadington.

The said cemetery known as "Woodlawn Cemetery" is to be governed
by the City of Leadington. There is hereby established certain rules
pertaining to cemetery operations in general, which shall be adhered
to by all parties.

There is hereby created a Woodlawn Cemetery Advisory Committee,
consisting of three (3) members, a Chairman, a Vice Chairman and a
Secretary, who shall be appointed by the Mayor, with the approval
of the Board of Aldermen; the first three (3) appointees shall be
appointed for a term of one (1), two (2) and three (3) years, and
thereafter each shall be appointed for a term of three (3) years,
or until a successor is appointed and qualified, so that only one
(1) term shall expire each year; the duties and purposes of the Committee
being to supervise the management of the Cemetery, to advise the Board
of Aldermen relative to the operation of the Cemetery, including the
sale of lots and to do any other things connected with the Cemetery
with permission of the Board of Aldermen.

Any deed for the sale of any lots shall be executed by the mayor
and Board of Aldermen hereby gives the said mayor the power to execute
same, so long as the sale is made for the price designated by the
Cemetery Committee and so long as the sale price therefor is delivered
to the proper fund.

Any perpetual funds in existence at the time of the creation
of the Committee shall be maintained as perpetual funds for the use
on the maintenance of said Cemetery, and this shall include any additions
thereto as a result of gift, bequest or otherwise; and these funds
and any other regular funds shall be maintained in the name of the
City of Leadington as special funds supervised by the Board of Alderman.

All the powers and duties of the Cemetery Advisory Committee,
whether mentioned specifically herein or not, shall be subject to
the supervision, control and consent of the Board of Aldermen.

The Woodlawn Cemetery Advisory Committee shall meet at least
once each six (6) months at some time and place agreeable to the Committee.
The Advisory Committee shall report orally or in writing to the Board
of Aldermen, which report shall be in full and complete detail and
covering all matters acted upon by the Advisory Committee.

A. Under the provisions of Section 214.020 Missouri Revised Statutes,
1989, there is hereby established a "Perpetual Care Fund" for Woodlawn
Cemetery owned by the City of Leadington, Missouri.

The Board of Aldermen hereby ordain that ten percent (10%) of
the amount paid for a lot in Woodlawn Cemetery shall be placed in
a separate account to be known as the "Leadington Woodlawn Cemetery
Perpetual Maintenance Account."

The income derived from the Woodlawn Cemetery Perpetual Maintenance
Account shall be used for the preservation, care, upkeep and adornment
of said cemetery or the repurchasing of cemetery lots previously sold
and for no other purpose.

The said cemetery known as "Woodlawn Cemetery" is to be governed
by the City of Leadington and the ten percent (10%) to be set aside
for the Woodlawn Cemetery Perpetual Maintenance Account is to be subject
to rules and regulations promulgated through said Board shall place
the same in an interest earning account in a bank, but with the express
understanding that if need be, both principal and interest can be
used from this account for the purpose of caring for and maintaining
the said Woodlawn Cemetery.

Any person who violates any provision of this Chapter shall, upon conviction, be deemed guilty of an ordinance violation and shall be punished as set out in Section
100.220 of this Code.
