There is hereby established a Fire Department in and for the
City of Leadington, which shall consist of a Fire Chief, one (1) Assistant
Chief, and such volunteer firemen as may be enrolled by the Fire Chief
with the consent of the Mayor and Board of Aldermen.

The Fire Department shall have the charge of the fire apparatus
and shall keep the same in good order for immediate use. For the purpose
of effectively assisting the firemen in the discharge of their duties
the personnel of the Fire Department shall as often as practicable
test the condition of said fire apparatus. Upon arrival at any fire,
the members present shall take all necessary and proper action to
extinguish such fire as quickly as possible, and with the least damage
possible. The Department shall take all reasonable steps necessary
under the circumstances to prevent the spread of the fire and to prevent
damage to any adjoining property.

If there are serviceable fire trucks with adequate equipment,
and a request for firefighting equipment outside the City limits,
the Fire Chief, or in his/her absence the Assistant Chief, may determine
whether to respond to such request, depending upon road conditions,
water supply and other circumstances then and there existing. The
decision of the Fire Chief or Assistant Fire Chief shall be final,
and shall in no way subject him/her to liability.

A. Fire Chief. The Fire Chief shall be appointed by the Mayor with the
consent of the Board of Aldermen. The Chief shall hold office for
a term of one (1) year and until his/her successor is appointed and
qualified.

It shall be the duty of the Fire Chief to examine and report
monthly, or more frequently as needed, to the Mayor the condition
of the Department and its equipment. The Fire Chief shall recommend
such alterations, improvements, and additions as he/she may in his/her
judgment deem necessary and appropriate. It shall also be his/her
duty to ascertain and report to the Mayor the condition and efficiency
of the Fire Department, and if the Department or any of its personnel
shall fail to observe and enforce its rules and regulations or its
efficiency shall otherwise be impaired, to report the same to the
Mayor, with such recommendations for corrective measures as he/she
may deem appropriate.

The Fire Chief shall examine all buildings and structures, and
shall examine all places where explosives, inflammable and toxic materials
are kept within the City, and shall report their condition at least
once each year to the Mayor. The Fire Chief is hereby authorized to
enter any and all buildings and places for the purpose of inspecting
the same, provided that the Chief shall, to the maximum extent reasonably
practicable, endeavor to secure the permission of the owner before
entering upon such premises.

The Fire Chief shall from time to time report to the Mayor the
condition of fire escapes on or within public buildings, and on other
buildings required by law to be provided with fire escapes.

The Fire Chief shall keep an inventory of all of the City Fire
Department property, equipment and apparatus and shall report the
same to the Mayor at least once each year.

The Fire Chief shall keep informed and make a report as to the
condition of the City water supply and fire plugs at least once each
year.

The Fire Chief shall keep the Department, its equipment and
apparatus in good condition, and at all times ready for inspection.

In the exercise of his/her duties, the Fire Chief may delegate
to the Assistant Fire Chief or to other department members such responsibilities
as he/she may deem appropriate.
B. Assistant Fire Chief. The Assistant Chief shall be elected annually
at the first meeting of the Fire Department after appointment of the
Chief, said election to be by the members of the Fire Department,
including the Fire Chief and all enrolled volunteer members. The Assistant
Chief shall hold office for one (1) year and until his/her successor
is appointed and qualified. The Assistant Chief shall assume the duties
of the Fire Chief in his/her absence, or in the event of vacancy of
his/her office until a new Chief is appointed. The Assistant Chief
shall assist the Chief in the performance of his/her duties and shall
obey his/her orders.

The Chief, Assistant Chief and all firemen shall each receive
a fee of five dollars ($5.00) for each fire call they shall actually
respond to. The Chief shall present a bill to the City for these fees,
and the City shall pay such fees to the Department for distribution
by the Fire Chief according to calls answered by each individual.
A. Nothing in this section shall be construed as prohibiting the Board
of Aldermen from granting to the Chief, Assistant Chief and firemen,
such additional compensation as the Board may deem appropriate when
the service in the Board's estimation merits extra compensation, as
in the case of any large conflagration or extended fire.
B. The Fire Chief shall, in addition to the foregoing, be reimbursed
for the expenses of performing his/her duties, not to exceed one hundred
dollars ($100.00) per year, said reimbursement to be payable monthly.

The Fire Chief, all officers and firemen may be removed from
the Department by the Mayor and Board of Aldermen at any time, provided
that such individual is afforded a hearing before the Mayor and Board
of Aldermen upon at least five (5) days' notice.

A. No person shall wilfully and without proper authority remove, take
away, keep or conceal any tool, appliance, equipment, or other article
or apparatus owned or used by the Fire Department.
B. Any
person violating this Section shall, upon conviction, be assessed
a fine of not less than twenty-five dollars ($25.00) nor more than
five hundred dollars ($500.00), or be confined in the City jail for
a period of up to thirty (30) days, or by both such fine and incarceration.

A. All Motor Vehicles Fires. The Fire Department's rate to respond to
such a call shall be one hundred dollars ($100.00) to five hundred
dollars ($500.00) for all such calls: however, if the owner is a resident
or no insurance pays, they shall not be billed.
B. Petroleum And Other Products Spills. The charge for answering Fire
Department calls concerning petroleum and hazardous materials spills
(as defined by U.S. Department of Transportation in CFR Title 49 or
by Missouri Department of Natural Resources) exceeding fifty (50)
gallons shall be one hundred dollars ($100.00) for responding to the
call and five hundred dollars ($500.00) per hour for firefighters
and fire equipment plus normal equipment rates and for private contractors
necessary for the containment, cleanup.
C. Other Calls. All other charges for non-residents, one hundred dollars
($100.00) for responding to the call and five hundred dollars ($500.00)
per hour.
D. Billing. A copy of the report will be filed with the Leadington City
Clerk and billing will be done by the City Clerk; an account will
be set up in the Leadington Fire Department Account. This account
will be part of the Fire Department budgeted money.

The Fire Department shall be in charge of the fire apparatus
and shall keep it in good order for immediate use. The Fire Department
is for the City of Leadington and shall be on call to assist all Leadington
residents in time of need. All firemen must be ready to respond to
calls with firefighting equipment and extinguish fires as quickly
as possible, and with reasonable steps necessary under the circumstances
to prevent the spread of the fire and to prevent damage to any adjoining
property. Fireman answer to the Fire Chief, Mayor and all Aldermen.
All volunteer members may come before the Board of Aldermen with any
complaints or request. The Chief may remove any inactive firemen within
reason from the Fire Department. Ten-day notice must be given and
reason why, in order to get all the fire equipment returned to the
Fire Department, with the help of the Police Department if needed.
