The installation of a fence, swimming pools, spas or hydro massage tubs and/or portable carports is permitted within the municipal limits of the City of Leadington under certain terms and conditions as herein set forth.

A. 
All applications for construction shall specifically state the following:
1. 
Name and address of the owner of the property;
2. 
Name and address of the person installing;
3. 
A sketch of the area;
4. 
Materials that will be used in construction;
5. 
The reason (for fence);
6. 
Legal surveys and/or letters from adjoining property owner(s).

A. 
All fences constructed in the City shall harmonize with their surroundings, the fence should be level with the ground if the ground is fairly level, and it should either step down or follow the contour of a steep slope. The size of the fence should be in proportion to the site, neither dominating nor being dwarfed by its setting. The materials shall be in keeping with the house on the lot.
B. 
Fences constructed in the City shall be:
1. 
No more than six (6) feet in height except within thirty (30) feet of the intersection of two (2) street lines, in which case the fence shall be no more than thirty (30) inches in height, unless, due to special circumstances approved by the Planning and Zoning Commission. Those special circumstances shall be documented by the issuance of a special permit for the fence to be erected to a greater height than provided herein.
2. 
The following types of fences shall be allowed to be constructed and all other fences must receive a special permit and approval by the Planning and Zoning Commission. In all cases, the Board may require additional information, but generally the following are guidelines for the types of fences to be constructed:
a. 
Picket fence: should be of a smaller height than six (6) feet;
b. 
Post-and-rail fence: may be built from split or dimensional lumber;
c. 
Grapestake fence: normally made of split redwood;
d. 
Wire fence: may be a chain link fence or a welded wire fabric;
e. 
Lattice fence.
3. 
The above list of types of fences is not meant to be all inclusive; however, the Planning and Zoning Commission must approve the type of fence and issue a permit, and it must meet the requirements.

Swimming pools, spas, hydro massage tubs and any appurtenances thereto shall be located in a rear yard not closer than ten (10) feet to any property line, except for boundary fences also serving as pool barriers. Swimming pools must be fully enclosed by a fence or barrier. No swimming pool, spa or hydro massage tub shall be permitted in an industrial district.

Portable carports entirely open on two (2) or more sides shall be permitted in a required side yard and not nearer than five (5) feet to any side lot line. Any carport not entirely open on two (2) or more sides shall be permitted only in a rear yard not nearer than five (5) feet to any side or rear lot line. Any portable carport in a required rear yard closer than ten (10) feet to the main building shall be regarded as part of the main building for determining side and rear yards. No such carport shall extend forward of the front line of the main building.

No person shall construct/install a fence, swimming pool, hydro massage tubs and or portable carports in the City of Leadington without first submitting an application.

Any person who violates any provision of this Chapter shall, upon conviction, be deemed guilty of an ordinance violation and shall be punished as set out in Section 100.220 of this Code.
