It shall be unlawful for any person to make or cause to be made,
or help, and/or assist in making any excavation for a sewer, gas,
water, or other connection or for any other purpose whatever in public
street, alley, or other public place, or in any public easement or
right-of-way in the City without first obtaining a permit from the
City Collector.

A. Permits shall be issued by the City Clerk on the deposit with the
City such sum of money as in the judgment of the City Clerk, or his/her
designated representative, will be sufficient to restore the street,
alley or other public thoroughfare, easement or right-of-way to as
good condition as it was before the excavation was made, and to pay
all inspection fees incurred therein.

The City shall retain out of the amount so deposited a sufficient
sum to cover the costs of superintendence and inspection of the work
authorized by such permit at a rate as determined by the City consumed
in such superintendence and inspection, and the balance of such deposit,
if any, shall be returned to the depositor when the work has been
completed and the place restored to its original condition. If not
so restored, the City may cause it to be restored and pay for such
work out of such deposit and any unexpended balance shall be returned
to the depositor. All backfills shall be made with a granular or suitable
material according to the specifications which may be prescribed by
the City Clerk or his/her designated representative.
B. Any person engaged in making frequent excavations may, in lieu of
a deposit as above required, file a bond with the City in an amount
determined by the City Clerk conditioned upon the restoration of the
surface of any excavation made to its original condition as required
by ordinance. The deposit of such bond shall not, however, release
the applicant from paying a sufficient amount of money to pay for
the superintendence and inspection of each excavation as set forth
in this Section.

Blanket permits shall be issued to franchised utilities upon
the application to the City Clerk and letters of agreement will be
executed specifying details of said blanket permit.

Emergency excavations by utilities may be completed and permit
granted after the fact upon certification that said emergency excavation
was necessary for the health and safety of the citizens of Leadington.
C. Wherever practicable where an excavation is made for any purpose
in an improved street, it shall be made by tunneling or in some other
manner that will not disturb or destroy the surface of the street.
