The Township of Lakewood pursuant to powers designated in N.J.S.A. 40:55B-1 et seq., has created an Industrial Commission for the purpose as set forth therein; and it appears necessary and desirable that, in order to coordinate the various programs and activities of the Township Committee and the Industrial Commission, and the municipal office handling foreclosures, and to properly channel all of the activities wherein they are engaged in the process of acquiring, preparing, developing and disposing of lands for industrial purposes under a department head responsible for coordination of all of the activities, a department is established which shall be known as the Department of Economic Development.[1]

There is hereby created the Department of Industrial Development whose Department Head shall be entitled Director of Economic Development. The Department Head shall be appointed by the Township Committee by majority vote and shall hold office for a term not to exceed two years, subject to removal by the Township Committee by a majority of its membership in the same manner and for the same legally sufficient cause as otherwise set forth in subsection 2-5.5, entitled "Removal of the Township Attorney." The term of office shall be computed from the effective date of the appointment.

The Director of Economic Development shall be in charge of and promote coordination between the aforementioned municipal departments and agencies and the business community and is particularly charged with promotion and development of municipal industrial lands and industrial parks within the Township.

The Director's secretary shall keep continuous records of the transactions of the industrial growth of the community and the activities of the Industrial Commission, as well as a continuous log of the minutes of the Industrial Commission. The Director shall also assist in obtaining funds from all possible government sources and to assist in the community in industrial development in cooperation with the Industrial Commission.

The Economic Director shall make the final determination as to the hiring, dismissal, promotion, or disciplining of the employees in his Department and to the extent the Director deems it administratively appropriate, he may delegate to the employees in the Department, consistent with applicable laws and regulations, any of the functions or powers delegated or assigned to him by this subsection; provided that any such delegation or allocation shall not relieve the Director from his administrative responsibilities for proper operation of his Department.

The Director of the Department of Economic Development is authorized and directed to prepare and submit to the Municipal Manager budget requests affecting the Department and the Industrial Commission. The Municipal Manager shall forward copies of such requests to the Township Committee. Additionally, the Director shall prepare long and short range recommendations as to the needs and goals of his Department. These recommendations will normally be prepared in connection with the annual and capital budgets, but may be submitted as separate memoranda.

The Director of Economic Development, and the resources of the Department, through the Director, shall be available to the various committees and boards of the Township for consultation and advice. The Department will conduct investigations and provide technical assistance to the Planning Board regarding all elements of the Master Plan, which include land use, conservation, traffic, housing, utilities, and recreational elements in the industrial areas. The Director shall coordinate the work of the Department with the Planning Board, the Zoning Board, and the Fire Districts of the Township. The Director shall also prepare recommendations for budget transfers affecting the Department.

As Director of the Department, he will be responsible for implementing the Department budget, and will be held administratively responsible for implementing and executing the departmental work.

In all instances where the Director has submitted a recommendation to the Municipal Manager, the Director should be available to meet with the Township Committee and the Municipal Manager relative to the recommendation.

The Director shall plan, organize and direct the planning and promotional activities involved in the economic and industrial development of the Township; plan, organize and direct a program designed to enhance the economic and industrial development of the Township, and coordinate federal aid programs relating to the economic growth of the Township.

The Director shall analyze and make economic, real estate and industrial surveys; analyze and evaluate business trends, legislation and developments affecting industry; maintain records of and provide information on labor availability, transportation, facilities, housing, hospitals, education facilities, tax structure of the Township, zoning requirements, etc. The Director shall attend and participate in conferences and meetings concerned with the industrial development of the Township and prepare reports and studies pertaining to the industrial and business development of the municipality; handle mail promotions directed to industrial firms in an effort to attract new ratables and make survey tours of available sites for prospective clients. The Director shall maintain up to date files on available sites, their specifications, and pertinent information on existing available structures. The Director shall refer prospective clients to various public and private agencies for receiving financial assistance, manpower training and assist clients with processing the necessary paperwork, and represent the Township's position on industrial development matters at various Federal and State hearings.

Within the Department of Industrial Development is hereby created the Office of Urban Enterprise Zone Administration.
a. 
Purpose. The purpose of this Office is to administer the Urban Enterprise Zone in the Township of Lakewood consistent with the enabling statute and administrative regulations governing same.
b. 
This Office will be headed by the UEZ Coordinator who shall have an appropriate title as designated by the Municipal Manager. The Coordinator shall have the status of a division head in the Township organization and shall be appointed for a term of one year by a majority vote of the Township Committee.
c. 
Duties and Responsibilities. The Office of the UEZ shall have the following responsibilities:
1. 
Monitor Township compliance with statutes and regulations governing the administration of the UEZ office; interface with the New Jersey UEZ Authority Office and staff;
2. 
Promote zone benefits to local businesses and help local businesses to satisfy requirements for designation as "qualified businesses";
3. 
Coordinate various agencies and personnel to increase business and employment opportunities within the zone;
4. 
Implement initiatives set forth in the approved application;
5. 
Design a plan of zone development in association with the advisory committee;
6. 
Carry out such other functions as may be directed by the Municipal Manager and/or his designee in furtherance of the goals and objectives contained in the approved application;
7. 
Carry out such other economic development functions as may be necessary.
