There is hereby established in the Town of Secaucus, County
of Hudson, State of New Jersey, the Secaucus Department of Consumer
Affairs.
It shall be the function of the Secaucus Department of Consumer
Affairs to mediate consumer complaints and exercise such powers and
duties under the Consumer Fraud Act (N.J.S.A. 56:8-1 et seq.) as have
been rendered delegable by N.J.A.C. 13:45A-13.1 et seq. This office
shall handle consumer complaints directly and by referral from the
New Jersey Division of Consumer Affairs and/or may refer consumer
complaints to the New Jersey Division of Consumer Affairs or other
state or federal agencies.

The Department of Consumer Affairs shall be under the Law Department which shall have responsibility for administration of said Department and may promulgate rules and regulations to meet the Department's purpose as outlined in Section
33-2, not inconsistent with state law.

The Secaucus Municipal Director of Consumer Affairs shall exercise
those powers and duties under the Consumer Fraud Act (N.J.S.A. 56:8-1,
et seq.), as have been delegated pursuant to N.J.A.C. 13:45A-13.1
et seq., provided that such Director is certified by the New Jersey
Division of Consumer Affairs and acts in accordance with and complies
with the provisions of N.J.A.C. 13:45A-13.4. The Director may serve
in an acting capacity until such time as certification has been completed.
Certification of the Secaucus Municipal Director by the New Jersey
Division of Consumer Affairs constitutes that the Secaucus Office
of Consumer Affairs is a certified State CALA Office pursuant to N.J.A.C.
13:45A-13.1, et seq.
